I would advise you that I was appointed Administrator of the above
companies jointly with my partner Alistair Steven Wood by the
directors on 14 November 2007. I am authorised to act as an
Insolvency Practitioner by the Department of Trade & Industry and my
partner is authorised by the Institute of Chartered Accountants in
England & Wales.
The companies have ceased trading and their offices are now closed.
The statutory purpose of an Administration consists of three
objectives:
· rescuing the company as a going concern;
· achieving a better result for the company’s creditors as a
whole than would be likely if the company were wound-up (without
first being in Administration);
· realising property in order to make a distribution to one or more
secured or preferential creditors;
Within eight weeks (or such longer period as the court may allow) of
the date of the Administration Order, I am required to prepare
proposals which I will publish on the Joint Administrators’ website
https://www.phoneboxdirectinformation.com.
As Joint Administrator I am not in a position to pay any amounts due
by the company in respect of contractual obligations entered prior to
the date of the Administration Order.
Following my appointment customers have requested a response to two
specific questions namely:
· Recovery of cash backs due from the company.
· Contractual obligations with the network provider.
As far as the cash back is concerned my current estimate is that
there are over 30,000 customers who may be eligible to make cash back
claims. My current estimate of this liability is between £4-10
million. The companies’ assets are less than £250,000. It follows
therefore, that after the payment of the expenses of the
administration and the preferential creditors (wages and holiday pay
owed to the employees) it is unlikely that there will be funds
available for unsecured creditors.
Turning to the second matter, I am unable to comment on a
customer’s contractual position with their network provider,
customers must therefore, either speak to the network provider
directly, take legal advice or contact their local Citizens Advice
Bureau or Trading Standards Office. The network providers and/or
their agents should not be referring you back to me.
Please refer to the Joint Administrators’ website

updates for the benefit of customers and creditors. This website has
been set-up to enable you to record your claim against the relevant
company. Please do not write to my office to submit your claim as
written communications will not be acknowledged.

Hi guys 'n gals,
Got my email from the administrators today too. Registered as a creditor and they confirmed that the lying cheating scumbags at PBD had been due to pay cash back of £420 in total. I have received ZERO:eek: , but when I took the contract out in May I knew the risks, and accepted that the sh*t might h*t th* f*n.
Now that it has been extruded through the fan and spread liberally over the surounding neighbourhood, I am very pleased that Vodafone are helping clean it up.
I phoned them a few days ago and they phoned back the next day to offer a deal. my signal cut out and I lost the call. I waited for them to phone back, but they didnt. so next day i called again and they left a memo on the system. They called again, but again reception was cr 'poor' ap and I didnt get anywhere. Phoned tonight and 20 minutes later they called back.:T
I am just off the phone to them having arranged for 12months at 17.50 gbp/month and including all my 500 mins and 250 txt from the PBD deal.:D They offered 750 minutes and unlimited txt & internet for the 35 gbp I am already paying, but I never use that much. Also they offered to terminate the contract at the original contract end (May), but I reckon the 17.50 deal is pretty good, so I've gone with the 12 months.
The Vod guy said they are the only company doing anything for their customers, (sure to win brownie points) so I feel sorry for the thousands of people left footing big bills from other mobile companys.

Is their anybody with a watertight case with regards to their claim ie 'signed for' recorded. copies ,witnessed etc who has had a defence lodged on MCOL which is obviously untrue? The reason i ask is:-
' By completing a statement of truth you certify that the information provided is true. A person who completes a statement of truth without an honest belief in the truth of the given information is liable to proceedings for contempt of court' to quote MCOL. This applies to employees as well as directors.
I did'nt send recorded so i don't have a watertight case.
Is this not a criminal offence which the police would have to investigate if requested?
I was very careful to do all that stuff, (signed, witnessed, recorded claim) but is there any point at all in doing any more than registering with the administrators? I dont think you can take them to court now since they are in administration, but is there anything else?
Can I start a MCOL at this stage, or is that the same as taking them to court? Is there any point anyway?Why dont we just go round and beat the value out of the directors using clubs fashioned from papier-mashe contract papers studded with mobile phones? :mad: :wall:
I would be interested to know where the directors go next, and what sort of business dealings they get in to.
Anyone know where they live???

A MCOL is the same as a small claim via the county court. It is an easier (and slightly cheaper) way to do things, as right up to the defendant issuing a defence it can all be done on-line. Should the defendant ignore the summons or admit the claim then judgement can be obtained on-line as well.
You could start one now, but although you would doubtless win, you wouldn't get any money from them, so really a waste of time and money.0 -
I'm with Vodafone, got offered the 1/2 price rental last month.
Vodafone just debited the full amount today, £35.
Wasn't the deal supposed to take effect immeadiately ?
I think your next bill will show a credit for the period you should have had at half price, but were charged full price for.
So hopefuly the january bill will be less than £17.50 (unless you used internet or exceeded your inclusive minutes.)
I was told that the billing system takes a little while to catch up with the ammended tarrifs. Might still be worth calling 191 to check though.

Just received my first bill since phone conversation re reduced bill, and it is in line with arrangements agreed over the phone.
To reiterate: I managed to downgrade my Vodafone tariff online to Anytime 75, and after my callback about CNM in administration was then offered half price on THIS line rental, so I am now paying £10 a month + VAT. I understand others have tried to change their tariff online since I posted about this, and been unable to do so - maybe Vodafone have closed this loophole, but I got a message on screen to say it wasn't possible (though in fact I had managed to change the tariff).
This is may only be helpful if you can manage on fewer minutes. Worth a try for some!0
