If your network provider can't show you the signed contract you are within your rights to cancel with one month's notice:

This is an old red herring. It has been raised several times and anyone relying on that is treading a very dodgy path. You would have to be absolutely certain of your ground before cancelling any direct debit.0

Me and my boyfriend both bought phones from CNM and were just about to claim the first 4 months cashback. In fact I was just checking their website to make sure the claims address hadn't changed when I saw they'd gone bust.
Therefore we stand to loose about £1k between us. However, I am actually quite happy that this has happened. At the back of Martin's book it states "...I Hope the Money Diet No Longer Works. If the entire nation followed the Money Diet properly, this book would become worthless...Providers would learn marketing gimmicks would fail, so they'd give up, and there'd be nothing for us to take advantage of any more.
By correctly claiming, we've destroyed CNM so that they can no longer profit from those who make errors and loose out.
Also, we were in our 3rd year of 12m free and knew the risks, so how can we complain?Proud to be a moneysaver! :cool:0 -

I have read so much stuff about all this over the past few days I can't remember where I read it but apparently what your report says doesn't apply to customers who bought over the internet through CNM etc. I think it was a report by Trading Standards. If anyone knows which report I am referring to perhaps they might post it on here?0 -
Hi, It relates to dialamobile and Instore customers. Dialamobile shredded all thier paperwork, so the networks dont have confirmation that contracts were read, whereas CNM and PBD had the Terms and Conditions on thier website.0

Mobilejunkie and Elijay who the hell do you work for? How dare you blame the consumer? Its black and white. You advertise you deliver! You look at the situation as an investment but some literally believed what the advertisement claimed to be able to deliver. At the end of the day if a company advertises that they are going to provide a service, yet the business model doesn't allow for it then its misrepresentation. I have an email from an associated company who are still solvent from 2006 when I requested a cashback form as the link provided did not work, this implies partnership and they will soon be served by moneyclaim.
I feel that we are living in a dog eat dog world. If the administrators can show that business plan was simply a pyramid scam then, claims could be filed against the directors themselves which would mean personal assets would come into play.
I believe the administrators are regulated by the fsa so maybe its time some complaints were lodged with them on the grounds that the administrators are not acting with due care in order to update that bloody website with more information.0 -
sorry, but it's a completely different senario. the contract for cashback is with cool new mobile, not the network
That's exactly Coca Cola's argument. "The children don't work for us, they work for the contractors that supply Central Izalco, so it's not our responsibility"
Of course these are not exactly identical situations; Coca Cola's example is seen from the supply chain, our cashback contracts are in the sales chain. Also, whereas the children who harvest the sugarcane never directly come into contact with Coca Cola we enter into a contract both with the Networks and the 3rd party.
That's all beside the point I was making. Where the analogy comes in is that both Coca Cola and the networks have business partners that don't adhere to ethical standards. If they want they can chose to stop doing business, whether through supply or sales. The interesting question is why is Coca Cola so hesitant to exert influence down it's supply chain? After all, negative publicity from Human Rights organisations could get the brand tarnished! I can only conclude that they reckon for the moment that taking such measures must have more severe financial repercussions than the negative PR from Human Rights organisations is doing.
We could similarly argue about how much the networks have actually benefitted from the fact that these 3rd parties are actually flooding the market with 'artificially' cheap contracts. People are lured into entering higher tariffs than they might have otherwise done because the cashback will refund them. That is all extra cash for the networks.
Don't get me wrong. All of the above are just philosophical considerations. Me being the victim of a £420 gamble that went the wrong way would be really pleased if Vodafone would lower my 4 remaining months from £35 to £5. I'm not advocating that they have the responsibility to do so.0 -
Hi yeah,
I got mobile phone from Phoneboxdirect 6 months ago, send my first cashback claim 3weeks back and trying to track them. but when i visited their website yesterday it's mentioned there they are not able to pay any cash backs(http://www.phoneboxdirect.com), contact ur service provider then I rang Orange, they are saying they are not aware of anything like that. my contacrt is 12months i am paying 40£ per month.
I am scared what do i need to do for my money pls help me.

maybe we should have two separate threads re this. One on information that will actually help those of us stuck with the CNM situation and another to let people discuss the pros and cons of the networks, blah blah blah.
