but if I let them take me to court and I win wouldn't that be bad for them? They'd have to pay fees and stuff right?

For how much do you reckon you could 'take them' - realistically?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • You appear to have a 'Slam-dunk win' based upon what your telling us about correctly paying but as people have pointed out Court is a lottery and it depends how clued up the Judge is who handles the case.

You could let it go to Court and the Judge says YOU should have pointed out the parking scammers error more robustly and YOU have wasted Court time, worse case resulting in you losing.

Its only speculation on my part I know very little about Court procedures etc but in the current climate the system favours the parking scammers (hopefully gonna change soon via Parliament)

They can be beaten but it takes a sterling effort AND going through all the Court procedures correctly and in order.

Write to the Scammers explaining their mistake and evidencing you HAVE paid and if they wish to take it to Court you will claim unreasonable behaviour costs, this will be good evidence for the Judge (should it go that far) that you tried to amicably resolve the issue, I once read on here that 'we're writing for the Judge' in any and all correspondence we have with scammers.

As I said I believe your in pole position with this but don't let complacency enter the arena, NOBODY!! can afford to make any school boy errors with these scammers or Court.
  • Okay so I have contacted them to provide evidence and demanded they remove my details off the system.

Will update with any further developments.

Does anyone else have any dealings with Tap2Park (company that was on the parking machine and who I paid for my parking with). They look completely legit for what I can tell but there is no google reviews etc.

No i don't mean me take them. I said if I allow them them to take me, and they lose then surely it would be bad for them. In any case i've contacted them now. I am eager to receive their reply. I won't hold my breathe for an apology!

It would be bad for them BUT only from the point of view of people on here who really enjoy seeing the scammers lose in Court but for every 1 they lose in Court there are probably 1000 they win so the scammers themselves wont give a toss.

They rely on bullying people into paying with their empty debt beggar threats and then threatening Court, that is enough to frighten the majority into paying, just deal with your own PCN and then maybe read a lot more on here as to how these scammers really operate, its a real eye opener, good luck.

Thye lose about £300 on a rent-a-solicitor plus a bit of admin and hearing costs - abpout £400 all in

You get, at most, parking mileage and a days wages, capped at £95.
  • I have had quite a few letters from UKCPS for a CPN. I have ignored this due to the fact that the CPN had no location on only the name of the town so I assumed that they could not fine me for the whole of the town. However the last letter had a post code of the "offence" I have been taken to court by them before. I have been ignoring them but now that they have issued a post code for the parking fine - will it still be worth my while ignoring them? Thank you

    Unlikely.

For a more comprehensive answer to your query can I suggest you start a new thread?

Trying to deal with the issues of more than one person in a single thread can only lead to confusion.

    Thanks for your understanding.
  • Quick update. When i sent an email yesterday with proof of my parking it said it can take 14 days to be dealt with. To avoid this whole court papers palaver, I decided this morning to call UKCPS - the girl said nothing they can do now its with DRP.

I then called DRP and got spoken to like utter crap by a man who just kept saying to me if you're not calling to pay we will see you in court. I am absolutely fumen. He ended the call saying you'll have your day in court - BYE.

Surely there is somewhere or someone I can make a formal complaint to about these SCUM companies?!

We constantly advise - never phone a parking company or a debt collector.

You've found out the hard way why that advice is given.
