UKCPS & DRP - should I go to court (and win)

Hi -

I have received a warning from DRP to say if i don't pay £160 they will advise their client (UKCPS) to take me to court. I have continued to ignore countless letters firstly from UKCPS and now frp, DRP.
The funniest thing about all this is I DID pay for my parking, and I also paid enough to cover me for 12 hours even though I only stayed for 5 hours at most. I have the email and receipt as proof and the company I paid for the parking was 'Tap2Park'.

Do I now, at this stage, contact either UKCPS or DRP. Or allow them to take me to court? The only thing i'm worried about is a CCJ on my credit file but am I right in thinking that if I turn up to court and win (which I will win) then no CCJ can be filed?

    even if you loose no ccj will be issued if you pay.
    why not be get it cancelled before it even gets near the court stage?

  • Well that's my questions really. Should I get it cancelled or go to court. I'd actually like to take them to court myself and win. They by the sounds of things I've read are both awful companies.

    I parked in Manchester, Cross Key Street. I used the machine and location code and paid on my card.

    You can't take them to court yourself....... the system doesn't work like that

    you should always get it cancelled.
    gong to court is a faff, and you will have your work cut out, plus there's the DDJ lottery at play.

  • but if I let them take me to court and I win wouldn't that be bad for them? They'd have to pay fees and stuff right?

    If its DRP that are threatening court, then stop wasting worry - They simply cannot start an action. Only UKCPS can do that.

  • Okay i shall take your advice and contact them. Just very confusing as lots of posts advise to not contact them at all. Also not sure how i'd have my work cut out though. I paid for my parking? They are a scam company by the looks of things.

    Let them take you to court if you are satisfied that the ticket was wrongly issued. Judges are not fools, they are aware of the mo if these companies, (many former clampers), and their bottom feeding dirty shirts.

    The whole industry is a scam, relying on threats of court, and the public's ignorance of the Law, A bill is currently before parliament which will regulate the scammers.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Second Reading in the Lords this month, and, with a fair wind, will l become Law later this year..

    All five readings are available to watch on the internet, (some 7-8 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    DRP are such a joke making stupid statements.

    All these morons can do is pass it back to the PPC saying they failed

    "they will advise their client (UKCPS) to take me to court"

    So funny .... bunch of idiots to ignore

    DRP are fakers and have added £60 ... again complete idiots and you not owe that.

    No point in talking to either scammer. If it does go to court which will probably come from the highly incompetent Gladstones Solicitors, just get the judge to whoop them with proof of your payment and claim your costs against them
