Brittania parking- BW Legal

Ah thank you!
Yes, I wouldn’t have thought of that!0 -
Hello.
Is this is something I should bring up at the hearing? I’m assuming bw will show up without Britannia?
“All defendants should read this article in today's Law Gazette and take a copy to their hearing.
https://www.lawgazette.co.uk/law/bar-council-solicitors-agents-could-face-prison-term/5059560.article
The conditions under which solicitors’ agents can be exempt under the LSA 2007 are: that the individual must assist in the conduct of litigation; must be under instruction from an authorised person (usually a solicitor) and that the hearing must be heard ‘in chambers’.
‘All individuals undertaking work as solicitors’ agents are urged to consider carefully whether they fulfil the requirements upon accepting every new instruction and when attending at court,’ the council said.
Essentially, this means that a solicitor's agent attending on their own is not likely to have rights of audience and may face 12 months free bed and board.
Defendants should also take a copy of the McShane v Lincoln judgment.
Had Mr R objected to the rights of audience of Mr Milton, it is very likely the judge would have agreed.0 -
That's pretty old news and not all Judges would agree. It is discussed on loads of threads and as always, searching the forum gets you a hundred times more results than asking a one-off Q on your own thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Sooo.. we lost.
If it was ‘a law built on morality’ we would have won but the ‘law wasn’t on our side’. We could’ve moved our car, our tried the phone number..
The judge didn’t let him add charges left right and centre.. lost at the cost of £185. Could’ve been worse I suppose. Never ever making that mistake again. If a machine doesn’t work MOVE YOUR CAR.
Pretty sure the £60 is still on there though. Feeling pretty deflated to be honest.0 -
So sorry to read that, after your efforts to defend it. That is a shame, given you tried to pay and were morally in the right.
Doesn't sound if the fake £60 was allowed, the Judge saw through that. The £85 was small claim fees.So we visited the aquarium and used a brittania car park. We paid and displayed. Time was running out but we weren’t done, so hubby ran back to put more time on. All machines on all 3 levels were not working for neither cash nor card.
He left the car park and tried to use the app to pay for another hour or two but lack of signal meant this didn’t work. We only stayed another 30 minutes then thought we better leave. With 3 children and a newborn (who needed a quick feed before we left the car park) an the 10 minute walk from the aquarium to car park we were an hour over our parking ticket (but not through lack in trying to get another!) there was no ticket on our windscreen. Thought we were okay.

That's a shame.
This is judge lottery and the county court is not stable
So we are aware, which court and which judge please
Does not sound if the fake £60 was allowed otherwise it would have been around £220 ?
You lost but so did BWLegal as by the time they pay the PPC, they already paid £25 in the court fee, the cost of the rep, so in real terms, they have to allocate £160 leaving very little for them.
Of course they probably take a share of the ticket
All in all, they work on penny's and that's why real solicitors would never get involved
Don't forget to pay as the judge directed and your credit file remains clear
The aquarium ...... it is worth highlighting the dangers of this car park run by Britannia on social media and as the local media pick up on these stories, talk to them about "visiting the aquarium and be taken to court because of dodgy pay machines" ...... you can have the last word0 -
Thank you both!
Ah that’s good then. The judge said only the original £85 to pay then obviously the £25 court fee got added on and wasn’t sure if £60 was for bw or not. And a bit of interest..
It was supposed to be at Bodmin county court but got changed last minute yesterday afternoon.. so it was at Truro county instead..
The judge said at the end he’s very sorry, and he’s had tickets in the past too, but the law is the law?? What? I thought for sure he was on our side until the summary at the end, he was at BW the whole time.0 -
At least you defended and didn't have to pay the fake £60 that many PPCs still add to every claim despite not actually incurring it.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The law is the law ........ that's what we expect, did he not understand POFA2012 which is the law ???0 -
so sorry the courts let you down ..... but as mentioned 'go to town' with the local press/ media and give them some back ....
