Brittania parking- BW Legal

Hello.
I’ve read through the newbies bit but because of panic it’s all gonna big over my head..
So we visited the aquarium and used a brittania car park. We paid and displayed. Time was running out but we weren’t done, so hubby ran back to put more time on. All machines on all 3 levels were not working for neither cash nor card. He has evidence of one working. He left the car park and tried to use the app to pay for another hour or two but lack of signal meant this didn’t work. We only stayed another 30 minutes then thought we better leave. With 3 children and a newborn (who needed a quick feed before we left the car park) an the 10 minute walk from the aquarium to car park we were an hour over our parking ticket (but not through lack in fctrying to get another!) there was no ticket on our windscreen. Thought we were okay.
Fast forward 2 months and hubby gets an email with the charge. He wrote back an email with our ‘appeal’ if you will. I know now he shouldn’t have used ‘I’ and used his name but it’s done now. The appeal got declined! We’re now involved with BW Legal and if not responded in a few days they’re taking steps for court. They even managed to get hubbys mobile number and rang him at work today.
Do we have a good case should it go to court. The appeal got rejected and they said we could have rang them for a ticket or simply moved our car!

Will the aquarium have any say with the parking company if it’s not their car park? I’ll definitely ring them tomorrow!0

They may well do but PLEASE no talking to the random person who answers the phone.
You need the Manager, and if he/she says the Aquarium has no power to cancel these, ask who does because Britannia do NOT own the car park (laugh if the Aquarium try that old chestnut).
If the site is owned by a separate landowner it might be them who contracted Britannia, not the Aquarium, but often the onsite businesses have a method to cancel PCNs. Press for the Manager to check, if they think they have no power, ask them to please check with their line manager or the property/managing agent of the site.
REALLY GET UPSET ABOUT IT and if it's not them, ask for the property/site Manager's contact number or email instead.
Be a pain, stay on the phone, tell them you've told your family, friends and your local entire *playgroup/nursery/primary school/NCT group/Mumsnet* (whatever relates to you) of Mums, who are now planning on boycotting the place in fear of being sued for taking time to feed a baby when the machines would not let you top up the payment either. With a bit of googling I’ve found that it’s owned by another company not the aquarium.
Do you still think it’s worth ringing the aquarium?
Also found nothing but bad reviews for this particular car park because people even with time still left on their ticket have received fines and lost appeals and given in and paid the ‘fine’ (invoice..)!?0 -
I’ve contacted them. She didn’t know what she could do so is contacting the line manager and HR. I should get a call today!0

Oh also!
We have written a letter to BW Legal. We’ve had a letter from them claiming they’ll take us to court if not received payment or reason for non payment by the 27th of this month.
We’ve explained all that’s happened and enclosed a cheque for £4.50 to more than cover the hour we went over.
Is it a good idea to send this? I was going to send it first class recorded later...?0 -
At no point have you ever seen on ANY thread the recommendation to use Recorded post!
You need to send LEGAL REASONS why the charge is disputed

Okay scrap the cheque.

Search for reasons. Its explained dozens f times. Think about what proof of delivery becomes if delivery is refused, then realise your error.

By not signing for it they can PROVE they didn't receive it. There will be paperwork to show it was not delivered.
