I did request a record of the PDT machines, to see how long they were out of order on that day, in a SAR to Britannia in late January of this year. A response was given saying they are no longer dealing with me and all correspondence should be through B W Legal. B W Legal was asked (at the same time as I sent the SAR) to put my account on hold whilst I waited for all relevant information. They would not do this despite the Limitation Act giving them 6 years to pursue this case through court. “…your account will not be suspended from further collections activity unless we are instructed to do so by our client.” (Exhibit C)
Britannia has failed to provide such info needed therefore placing me at an unfair advantage in defending my case. As such, this case should be struck out.”

However, they have literally just, responded with their defence response. Just a simple sentence or two and the times that they had not previously given me from the PDT machines. Can I just make an edit note at the bottom
Or should I disregard it now that I’ve received the PDT times? It’s annoying as they still disregarded my SAR but I do have the information I asked for. Though it looks like something I could’ve typed out on Microsoft word lol. How do I know it’s official? Anyway they claim it’s proof the machines were working. And that we’re lying basically. Disingenuous I believe was the term 👍. Though it wasn’t as no ticket was purchased in the 15 minutes hubby was in the car park trying to renew 🤷🏽!♀️. So I’m not sure what they think it proves...0 -
Would something like this, added to the end of the above bit on my WS go okay?
“We have recently, as of date, received BWLegals defence response, included is the PDT machine record of the day in question, which we asked for in January 2019. They claim I am being ‘disingenuous’ which is proven by their record, however I fully dispute this as I have video evidence of the machine not working, and at the time I came to the car park, there is not one ticket purchased within that 15 minute period, so I do not class this as proof at all. ”

If you have a video that challenges the machine record have you informed BWL that you propose to use it in your defence. ?

I’m not sure if we informed just Britannia or both. Hmm. Does it matter?
I think I said in the defence that we have evidence of the machines not working.
I’ll have to have a look. It will on the information on the phone but I think the date and time is shown on the machine too.0 -
Okay so the video shows time and date.
The time is actually 2 minutes after a ticket was purchased though. That doesn’t help our case does it?
So he went to the car park at 1pm for a ticket the was running out at 1:20pm. For 20 minutes he tried to get a ticket. The video is for 1:22pm and shows it’s still not working.
But their ‘record’ shows they had a cash payment for a ticket 2 minutes before the video. There’s 3 other machines in the car park I believe.0 -

If you have informed either or, then I hope you have proof of this.
You do not want to be accused of hijacking them in court.
If you can show you informed them, then this alone would feature as number one in your defence0 -

I think you need to establish about the other machines. Each machine should have it's own number0 -
