The machine ending in 3 is the one used when videoing, as it was the same one as we purchased the first ticket & this one ended in

The print outs then contradicts your video and I would suggest that the video will over-ride the logs because these machines can still send data even being faulty

An ATM, similar technology will send data to the operator even though the facia shows a fault. That's how the operator knows they have to fix the machine

Haha thanks. I’m not sure how it all works with court and if what data I’m allowed to share etc. Though there was no full number plates so no personal data has been shared anyway.

Yes the yellow is when we came in, they highlighted that ha. It shows what machine we used hence we know which machine we videoed.

So back to the WS, I had stated that I requested a SAR and Britannia ignored, they didn’t send the record of machine or anything. Then a week ago I receive this record (asked for in Jan) in response to defence. So they’ve still not given because I asked, it’s been given to try show we’re lying, which we are not!

So would it sound okay in the WS to keep the bit about Britannia ignoring my SAR but then make another comment at the bottom of that bit, saying that we have as of recently received from BW the record, but we dispute that it is proof we’re being disingenuous and that the machines definitely were not working (then I’ll direct them back to the video in evidence? )

How would I word it exactly?

I sound far too rambly with what I want to say:

I did request a record of the PDT machines, to see how long they were out of order on that day, in a SAR to Britannia in late January of this year. A response was given saying they are no longer dealing with me and all correspondence should be through B W Legal. B W Legal was asked (at the same time as I sent the SAR) to put my account on hold whilst I waited for all relevant information. They would not do this despite the Limitation Act giving them 6 years to pursue this case through court. “…your account will not be suspended from further collections activity unless we are instructed to do so by our client.” (Exhibit C)
Britannia has failed to provide such info needed therefore placing me at an unfair advantage in defending my case. As such, this case should be struck out.

We have recently, as of date, received BWLegals defence response, included is the PDT machine record of the day in question, which we asked for in January 2019. They claim I am being ‘disingenuous’ which is proven by their record, however I fully dispute this as I have video evidence of the machine not working, and at the time I came to the car park, there is not one ticket purchased within that 17 minute period, and then one is purchased but not from the machine we had tried so I do not class this as proof at all. The machine with transaction ID ending in 3 can be seen not working in our evidence. We had tried 3 out of apparently 4 machines, and to be honest we would’ve tried the fourth machine but we thought there was only three.

Don't concern yourself about the BWL "disingenuous" bit, it's all a game to try to scare you. If we are talking about BWLegal. they are very disingenuous adding on the fake £60 claim and then signing a statement of truth ???? Think they take the biscuit on that one. :rotfl:

A WS is simple, it expands on your defence and tells the story from your point of view, and it is vital because it includes your evidence exhibits such as photos of obscured/tiny font signs, any relevant letters, permit/copy of your lease, copy of your authority to park, etc.

Following that you will find 7 or 8 examples of WSs and (should you want one) skeleton arguments.

Thank you, I have looked at that and do have a copy of my WS on page 6 or 7, that I have written using that kind of template.

I’m just rubbish with wording on paper, it reads like I speak ��

I’ll go through it later with hubby so I’m sure he’ll word it better anyway!
