Everything is in the NEWBIES FAQ, including an already-written appeal for BPA member companies.i have read that, but also some of the threads i have read relate to appealing to popla and not the land owner direct, whilst others say appeal to the land owners direct and not popla, you obviously dont find this as confusing as i do!
thank you for your replyok, thx, i cant seem to find post # 3, what does the post begin with please
Well you say you've previously read the sticky, it's still in the same place, it hasn't moved. The post number can be found in the top r/h corner - it is shown with a # in front of it. This post I'm writing is #63 by way of example.
The sticky only has 5 main posts, but the first 2 are very long, so you'll need to scroll down the page a fair way - keep scrolling. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

ok, is this the one i should be concentrating on and amend,
https://forums.moneysavingexpert.com/discussion/4822530/pcm-at-bluewater
because everything i am reading concerns, free car parks and shopping precincts where people speak to the managers, should i send this type of email to the landowner first?
thank you0 -

No it's not! That's from 2013.
It's the NEWBIES FAQ sticky near the top of the forum thread list, one page back from this one. Sorry, I can't go any further on this. Please note, we are not a legal advice forum. Duh.... all these years and i have never noticed this pmsl0 -
but everything i read.. all over the weekend relates to parking eye and talk to managers, staying at hotels, airports overstay and shopping, there is not one mention of appealing to a housing association?Sorry, I can't go any further on this.
thank you for all your replies

i have tried my best, the scammers win
Can you at least write to your MP, and perhaps the local papers. You are a BB holder living in a HA complex. This is a case which, had you applied yourself more diligently, you could have won hands down. You never know how far you can go until you go too far.0 -
No, youve let the scammers win
You were directed ot the newbies thread
It hasnt moved
It should be relatively clear than a post from 2013 is not going to be of much use.
if you want to pay these parasites, so they can harass bully and intimdate people who cant afford to pay, do so.0 -
Firstly, i unreservedly apologise for the way i responded to your helpful replies, looking back and reading the thread, i can clearly see how frustrated and anxious i had become, it's something i have suffered with all my life.
I have been carefully reading, i have read posts similar to mine but not exact,
i emailed my HA clearly stating my disgust at being harrased as a disabled person, i also emailed their head office as suggested, demanding they get this charge canceled, i also emailed the PPC stating
Please be aware than an occupant of the vehicle is the holder of a valid BB,
The keeper of the vehicle will also be complaining to their Housing Association, Their MP and their local Trading standards under the Equality Act 2010, "reasonable adjustments" and to take account of "protected characteristic" i attached a copy of the BB.
i did not name the driver
I received an email today from the PPC
Thank you for your email.
We would suggest that you follow the appeals procedure as laid out on the reverse of the charge, as you can provide any information, pictures or documents if you so wish. The appeals form can be found online at https://www.parkingticketing.co.uk.
Please see the attached images of the vehicle, the blue badge was not displayed as per the term of parking, these can be viewed at https://www.payptl.co.uk.
We kindly suggest the motorist to follow the appeals procedure.
kind regards etc
i do want to fight this charge, i do not want them to steal the little money i posses.
i shall now wait the 26 days before the appeal, this i believe to be correct, in the meantime i am reading other posts and taking snippets from each, which may be useful should the charge not be dropped and i get a POPLA code, i am also learning the structure of the POPLA appeal and noting which sections are relevant to my case.
thank you so much for the help you are providing0 -
Have you found and read the sticky thread for NEWBIES yet?
If so, have you found the template in blue text in post 1 of the NEWBIES? That is what you need to send to the PPC, from The Keeper. Either send it unedited, or add a one liner that an occupant of the car is disabled and therefore the scammers must allow more time.
Send the appeal around day 26.
If/when it is rejected, then search post 3 of the NEWBIES where you will find links to a number of PoPLA appeal points.
You should include anything relevant. These may include some or all of the following, plus any others that are relevant.: -
Not the landowner
No standing to bring charges in their own name (no contract)
Inadequate signage
Lack of grace periods
Non PoFA compliant NTK.
But first, please confirm that you have found the NEWBIES. and the five separate posts written by Coupon-mad.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0 -
hi fruitcake, yes i found the section and i am trying in advance to subtract snippets from various posts which will help my case should the PPC not terminate the charge, i will send the BLUE TXT appeal on day 26 unedited, with the added line that an occupant of the vehicle is a disabled blue badge owner also mentioning the Equality Act 2010, "reasonable adjustments" and to take account of "protected characteristic"
also where possible upload a copy of the BB
thank you so much0
