Hi, i have had a response from my HA HQ asking me to send a copy of the ticket so they can peruse the reasons as to why the ticket was issued, in my reply should i say that the BB scheme is null and void on private land, an occupant of the vehicle is a disabled person and the holder of the BB, upload a copy of the BB, then mention the Equality Act 2010, "reasonable adjustments" and to take account of "protected characteristic" ?

Hi, i have received the following response from my HA:
Thank you for your response.
I have made enquiries with the parking ticket company and whilst taking the Equality Act into consideration, they have reported the following:-
When entering private land, the motorist is governed by the term and conditions stated on signage. The motorist has parked the vehicle with a warning sign directly in front of it.
By exiting the car, they have accepted the terms and conditions. By not doing as the sign states, displaying a blue badge, they have failed to comply with the terms and conditions.
The signage is a contractual notice.
“by parking here, you accept the terms and conditions”. The motorist broke the contract by not displaying a badge.
The only way our wardens are able to identify whether the vehicle is entitled to park in the bay, is when a disabled badge is displayed.
I have attached the document that is provided to blue badge holders when the badge is issued. Please refer your attention to one particular section regarding private land.
Page 13 “Off-street car parks (such as Off-street car park operators should supermarket, hospital or local provide parking spaces for disabled authority car parks) people. However, it is up to the car park owner to decide whether badge holders can park free of charge. Do not assume you can always park for free.”
And most importantly,
“On-street’ disabled parking bays (Signs have a blue wheelchair symbol) You may park free and without time limit unless signs say otherwise (check local signs for information). You must display the organisational Blue Badge. Always try to use these bays
The sign stated you must display a valid blue badge, the motorist failed to comply with the restrictions stated on signage.
Parking on private land carried different terms and conditions than public land but ALL motorists must follow any conditions stated on signage.
It was the motorists responsibility to ensure a valid blue badge was displayed.
I can only suggest as do the company that the motorist appeal the charge with the ticket company with the information found on the reverse of the ticket.
any advice please? i would really like to tell the HA something like "if this issue goes to court etc, that they along with the PPC will be liable?" but i cant find the post i saw this in

Search for posts by Coupon-Mad, she often posts good stuff about the Equality Act and HA/MA's being held jointly responsible along with the PPC.0

Are using a mobile? I just tried the exact same as you, although lower case "equality act" and Coupon-mad in user and wait for it to offer. I got loads of posts. Annoyingly it is then a case of searching post by post.0

The Equality Act 2010 is a very powerful piece of legislation which companies ignore at their peril.
As my HA you are jointly responsible for the actions of your agents, should this PCN result in a court case, you would also be liable for any costs along with the PPC, and you will be called to court to defend yours and the PPC illegal actions
The Equality Act CoP isn't guidance. It's law in its own right, with fines for service providers who breach it.
It appears that you dont understand the Equality Act 2010, i will also be complaing to, and pointing this out to my MP and Local media services such as the consumer programme X-RAY.
As you have no intention of instructing your bunch of scammers to cancel this money scam you leave me no other option.

I like the body of the letter/e-mail (could have been written by C-m herself!) but I think you might want to tone down the final sentence unless you quote what MP's said in the house, which was just as strong.0
