Seems Napier have succumbed and have agreed to process my request, I received an email, post 10oclock yesterday evening, saying that "on reflection (on this occasion)" that they will deal with the SAR.

Don't know what to make of it, ever feel like your being watched? Not sure, but at least it's underway

It’s long been felt that Napier do look in here whenever their name is typed in the forum.

At one time we used to try to disguise their name using things like NAPPY, or N-A-P-I-E-R, or similar mashups to prevent them spotting threads and the advice we were giving.

I think the feeling now is, what the hell, let them get on with peeping, we can still beat them most times! :D

    Hello Nap. :hello:
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

You are being watched. A number of ppcs read here. As do a few people from the BPA.

Some know when to throw in the towel.

Why don't PPCs like Napier and Premier Park just shut down and do something for Society...

...I can dream. People who run PPCs must have no conscience whatsoever.

Evening, SAR now returned rather quickly, and predictably refused a PDT/VRN log and landowners agreement. I know I need to follow up on the log, any suggestions best way to approach it? I pretty much know they are going to continue to refuse regardless.

I received a parking ticket from a private parking firm, reason because it was paid via a mobile app and incorrect registration entered.
As you paid by mobile app, send a SAR to the app firm (RingGo or PaybyPhone or whatever it was).

Was it the compete wrong registration, automatically (and not sufficiently transparently) carried forward from a very old parking session? If so, also complain to the app provider that they have stored VRN data negligently and excessively and that they should never assume VRNs or location codes from a customer's previous parking sessions, as people use more than one car and location, and this data storing is unjustified, does not save anyone time and merely exposes motorists to parking firm scams.

If this was data carried forward by negligent and unnecessary presumption (because they can't just assume!) tell THEM you will report them to the ICO and if you end up out of pocket, as their client Napier is now using this data to sue you and blame you, then you will sue them for your loss caused by their app not being fit for repeat use.

(Above doesn't apply if you made a small typo in the VRN, or actually input the wrong VRN yourself - still defendable of course, but not the app firm's fault).

Thanks coupon-mad complete wrong VRN, (my wife's car instead of mine) we were regular users of the car park, which in a way made it far too easy for the wrong one to be used and carried forward unnoticed

I'll have a think on this, it's now over the 30 days from the LBC.

Doesn't matter if it is over 30 days from the LBC.

If your wife entered HER VRN, then SHE needs to send a SAR with proof of her car V5C, and state that she understands that her car VRN is featuring in a PCN (number xxxxxxx) her husband has received and under her GDPR rights she requires the data held from the PDT machine (or phone app, or whatever it was) records, relating to HER CAR.

She needs to be careful not to name herself as driving, hence my careful wording.

Sorry coupon-mad with the over 30 day thing, I was just stating where I am in the time scale, it wasn't meant to be relevant to the SAR.

The SAR from the PPC states that I was named as the driver on the appeal, not sure why ?? I let my wife fill out the appeal. Hence I wasn't sure

Now I've had a bit if time to read it, there are some odd things, apparently a male was observed returning to the car at pretty much the exact time the parking expired, (yet only 6mins parking observed on NTK) it seems odd as there was 4 people present that day

The thing is, only your wife can ask for data about her VRN. So she must do that, with her V5C attached to her SAR, and eventually they'll have to cough up the data about that payment.

OK, this is typical rubbish that you can blow holes in later.
