    Paypal do tend to side with the buyer though.

    I think returning the phone back to him (and not telling him) is a good idea, but like FloFlo said, if he starts a paypal dispute, then he would probably win.

    ..Unless you can stall him until after 30 days (I think) from the auction end - then it's too late for him to start a Paypal dispute..

    EDIT: I'm not sure what the timescale is for a dispute, maybe someone else knows?

    This is interesting as I had no idea this could be done. I have a auction winner with no feedback who won a low priced auction of mine for Jeans on Saturday, have had no contact - or payment - from them as yet and was concerned as have dispatched my other items from weekend auctions already.   • Like I said, get the phone imei independently verified. If it's not the same as the casing, tell the buyer what you have found and that you will be going to the police to report his attempted fraud. As a previous poster has said, you should be able to get the phone check at your local market. That way, you will know either way for sure if he has swapped the casing over and sent you back a different phone. If he hasn't sent you back a different phone, then move onto step two - proving he broke it once it was in his possession.

    We believe you, and he is trying to scam you, he is a liar and a cheat. Being fair and doing the right thing will almost certainly result in losing your money, I would now try to outfox him.

    I think taking the phone to have the IMEI properly read is a good step, if it's not your phone then you are in better position. If it turns out to be the same IMEI, then maybe you should think about playing dirty too.

    I hope you don't give in and refund him untill every possibilty has been explored, we are all on your side!

    Im currently trying to connect the D900 to my laptop to see if i can find the IMEI, might need some software to do this though..

    Not sure of the software. First thing remove all money from paypal account. Then when was the last time you emailed them? If so email him back saying that you are loading funds back into your paypal account and hopefully money should be sent very soon.

    You really need to try and send them back to him, maybe use a diffrent packaging as someone else suggested that way he wont know its a phone. As for senders address stick it in the corner on the back of the parcel with just your house number and postcode he wont have time to check that and sign for it. Don't use your name you dont have too.

    But do not send him any refund.

    I will if you want email ebay and say i'm concered about this guy buying and selling new and damaged phones.

    What you could do is email everyone who has sold to him has he tried the same with them.
  • wouldnt my account just go negative if a refund was given? Think theres £8 in there at the moment. Ive not heard from him in about a week..
    I will post it back to him this weekend, ill try disguise.. and use a friends return address. Still trying with the IMEI software..
