  • 30 days has just gone, but he has mailed, so i have now sent the text mentioned previously
  • He has started a papal dispute.. ill post details later as im not sure what i can do. Have i automatically lost the case?

    Possibly not.

    You might have some luck if hes lost the tracking number he used to send it back to you as he will need that.

    You didn't leave any money in your account did u?

    i paid for samsung d9oo 59 pound recieved it the screen was damaged sent email to seller he told me to return it which i did next day 27 october he told me he would get fixed waited for 4 weeks fobbed off 3 times today he informs me i broke phone and will return it broken to me.

    Would it matter if there was money in the account, surely paypal can withdraw if from my bank account

    If Paypal find in his favor, then if you have no paypal funds, they will still just take the money and your paypal account will be in the red..

    Did you manage to contact any of his other sellers to see if this has happened with anyone else? if it has it may help your case..

  • Sadly it looks like accepting the return was probably not a good idea, though paypal seem to side with the buyer 9 times out of 10 anyway.

    My friend had a similar thing happen to her where she lost a dispute, she rejected a return but paypal insisted on her refunding so my friend emptied out her paypal account and changed her address on it.

    She got a damaged item back, it was definately not the one she dispatched. Her account went red but my friend opened up a new paypal account.

    6 months later and she hasnt heard anything from paypal about the money she owes them. I'm guessing the buyer never got his money either as no funds were available.

    I wouldn't advise doing this but my friend was really p!$$3d off with paypals support, or lack of support.

    I'm still routing for you snake eyes. I really hope Paypal can see the bigger picture and look at all the other listings he's bid on, including damaged phones, plus the fact the box you sent your phone in was undamaged on return (meaning it was undamaged when it arrived), show he's been swaping phones & screens.

    It has been escalated to complaint - not as described. So i have sent the following

    I sent the D900 to David in the original phone box, well packaged and through UPS. The phone was in perfect working condition when sent, and UPS have will not deliver packages if damaged. I find it hard to believe that it was damaged in transit as i have checked the packaging that David returned to me. I wanted to see if this phones had beem tampered with. I believe either the screen has been replaced(looking at buyers past auctions)or has been damaged while inserting the SIM card.

    Least i have the handset and could get £25 if sold again on ebay
