    hi everyone
recieved email, exel are not certain who the driver was and to process appeal correctly they want to instruct to .. notify the driver of the vehicle to appeal to them directly, including their full name and address within 14 days
anyone had something similar? what to next.?
    thankyou

We must encourage you to read other threads, not just post on yours in splendid isolation:

    https://forums.moneysavingexpert.com/discussion/5783614

You will learn ten times more from an hour reading other Excel threads (only one 'L' in Excel when you search!) than on this thread asking questions one at a time as if it's something new (it's not!).

Settle down and have a go at searching the forum for 'Excel' and you'll be better prepared.

And, as shown in the link, send that complaint email to the DVLA if Excel are saying they CANNOT process an appeal without the driver's name. They cannot say that, they can only ask who was driving (not withhold appeal rights). Obviously you do NOT tell them who was driving.

You will know by now from reading the NEWBIES thread not to try IAS, and what it is.

Well don't miss any deadline from here on or you risk a default judgment against you with the potential for a credit-crunching CCJ.

The NEWBIES FAQ sticky, post #2 guides you through what you need to do. First job is to acknowledge service (AOS) of the Court Claim. There is a step-by-step walkthrough (with pictures) to show you how to do this.

What is the Date of Issue shown on the court claim form?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Why do you want to contest jurisdiction

(It refers to the jurisdiction of the court, not the claim!)

With a Claim Issue Date of 10th October, you have until Monday 29th October to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox link from post #2 of the NEWBIES FAQ sticky thread.

Having done the AoS, you then have until 4pm on Monday 12th November 2018 to file your Defence.

Loads of time to produce a perfect Defence, but don't leave it to the very last minute.

When you are happy with the content, your Defence should be filed via email as described here:

    1) Print your Defence.
    2) Sign it and date it.
    3) Scan the signed document back in and save it as a pdf.
    4) Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    5) Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    6) Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
    7) Wait for your Directions Questionnaire and then re-read post #2 of the NEWBIES thread to find out exactly what to do with it.

Why don't you just follow the guidance offered in post #2 of the NEWBIES thread?

The answer to your question is clearly spelt out in that Dropbox file I mention above.

You appear to be struggling on this. Do you have someone local to you who can sit down with you and work through it together?

Depending solely on hard-pressed forum regulars, operating in the Internet ether, won't (can't) provide you with the one-to-one support you appear to need.
