If the Defendant really doesn't want a hearing then that can be decided later - up to seven days before the hearing date.
At this stage, keep going as if the case is heading for a hearing.
This is more likely to force the Claimant's hand.
Fill in the Directions Questionnaire and return it in the same way and to the same email address that you sent the Defence.
Remember to send a copy to the Claimant too.0 -
thankyou should a witness be added? there was a passenger with the driver who witnessed a ticket being paid for . and would it help the case if the keeper can prove hewas at his place of work for that day ? also the car which reg was put in accidentally was at a garage having mot done and wasthere all day. or just keep it simple. thanks0

You can put '2' in the witnesses box, certainly. You plus the passenger.
And state your local court, and any dates you would not be able to attend a hearing. As per bargepole's post about how to fill in a DQ.

hi,
the notice of allocation to the small claims track,,witness statements to be in before end of the week and hearing next month.plus a 50 odd pages has arrived . not sure where to go from here, any help please. thank you0 -
does the defendant need to send witness information to the court ,including the defendants own information?0
-
All of this is explained in the NEWBIES FAQ sticky, post #2. I would have thought you would have been all over that part of the sticky given the imminent threat of court proceedings.
You have been advised previously to study this. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hi im sorry to be a pain, can someone help me please..i have read through the newbees again but still not sure as register keeper was not the driver that day. should proof be sent that rk was at work all day ? and should the driver send a seperate witness statement.? thankyou in advance so sorry i find this very overwhelming.. and so stressful 0

The driver does not send a separate WS as that would be naming them!
You simply need to write the story of what you know, as keeper, and refer to your evidence. And you know what evidence to file because I tell you...in the NEWBIES thread.
You can copy any of the example WS in the NEWBIES thread and show us tomorrow and we will comment.
This does not involve hours of reading.
You simply do Control & F and search the NEWBIES thread for the word WITNESS.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

1) should proof be sent that rk was at work all day ?
2) and should the driver send a seperate witness statement.?
1) yes, submit all your EXHIBITS (evidence) at the same time as the keeper WS
2) no , as that would reveal who was driving0
