  • I am currently in the process of claiming my Capital One charges via the courts. However i have today received a letter from my local court saying that Cap1 are going to defend all of the claim.

    Will i actually end up going to court or is this the normal proceedure for Cap1???

    Im a tad worried now, i thought after reading other posts on here that they would crumble at the first sign of court action and pay up in full but i now fear i will lose completely. I hope i have not ruined my chance of getting anything back.

    Got home from work today to find a letter from Cap1 saying they have now cleared off the balance off my card and are sending me a cheque for the rest ... they refunded all of my full claim .... woohoo!!

    just recieved letter to say they are offering 587.00
    original charges total 544.00
    so cash will be in the bank on tuesday
    it took 2 letters over 5 weeks!!!
    still fighting for my money !!!

    just rang Barclaycard and I will be receiving 639.91
    originall charges 588.00
    2 letters and a phone call over 8 weeks:j

  • Hi I have been in the same position, we got into financial difficulty about 2/3 years ago - some cards had been sold on to a DMA and two were CCJ's . However we claimed and have received thousands back :rotfl:- You wont rock the boat, and as I see it if they hadn't loaded our cards with charges, we wouldn't of owed them so much money + the interest, so I would definately go for it, it cannot get any worse.

  • Hi, I recently wrote to the HALIFAX to ask for my credit card repayment cover payments back (when I got my credit card back in 2002, I'd been pressured into having this). On the letter I asked in BOLD that the cover be immediately cancelled. I got a reply on 16/09 saying they will look into the case which could take 8 weeks. I then got my next credit card bill and the charge is still there although the amount is a lot higher than normal for the balance due (I keep all my statements). Any ideas? Should I wait until I've had another response about my charges? Anyone been in a similar situation?

    I wondered if someone can give me some advise please?

    I submitted a claim to Lloyds for credit card PPI for the past 6 years or so. I wrote to them asking for details of all the cards I have ever had and based my claim on that from 2001 onwards.
    Lloyds declined my claim so i sent it to the FOS, I have received a letter back today.

    The letter says that in my FOS form I said the PPI was for the last 5 or 6 years, but the cover was originally taken in 1995. I based the last 6 years on the info from Lloyds and that also I didnt think I could claim over 6 years old.

    I also mentioned that the sales adviser had been pushy etc, and Lloyds have come back with ' as you cant remember the date you took the claim out in, how can you remember what the salesman was like'

    The FOS say i need to show the business (ie Lloyds) made an error or omission and as yet they havent seen anything to support this. They have also included a copy of the original paperwork from 1995 which Lloyds say I ticked for PPI and then signed. On looking at this, I wrote a 'N' next to PPI, but it has been ticked, and the tick is completely different to how I do them - ie looks like it was completed by someone else but how do I prove this?

    I know full well that Lloyds mis-sold me the PPI, and the salesman was pushy, and that I didnt tick where they say I did - any ideas on how I go about proving them wrong to get my money back??

    Would be grateful for any help on this.

    Thats interesting about the FO...

    My amount against Capital One is £522.09 and has been with the FO for about ten days....From the wording on the letter it sounds as though they are snowed under and i thought i would be waiting for months.

    However a payment of £522.09 before Xmas would be a result

  • Hi everyone i was hoping someone could help me. Back in July i asked Barclaycard for my statements as to what Martin says to do. I enclosed a £10 postal order and then weeks later a letter came through the door saying i never enclosed payment but they would be happy to send out my statements once payment has been recieved. I phoned them up and the lady i spoke to said that they did recieve my £10 postal order and the statements would be sent out to me. (Im still waiting). Ive phoned heaps of times since then and each person i talk to they all say they will send out my statements. I was wanting to know if this is happening to anyone else adn want can i do? I filled out a complaint form to the Information Commissioner this morning but is there anything else i should be doing?

  • My first post. Ive been reading through the reclaim threads for some time now, and thought it was hard time i get myself on the band wagon and claim what is rightfully mine.

    The company in question is capital one. I sent my first letter 12th September 08 requesting a refund on my charges only, totaling £980. 23rd September 08 i received a reply offering £316 as full settlement. This is £664 less than what i expected. It appears that Capital one are only prepared to offer me the difference between the £20 charges i received and what they believe is a fair charge, £12. So for every £20 charge i incurred, they intend to refund £8. My question is what do i do now, accept the £316 and chase the remainder OR decline the offer and chase the full amount again in one swoop ??? Please please help !!

    As part of the £316 settlement, Capital One offered £20 gesture of goodwill as acknowledgement of interest incurred. When i calculated all the purchase and cash interest from my statements, it totaled £304. As i was expecting to get my full refund of £980, i never pursued the interest charges. Now my question here is, do i write to chase the interest incurred too ??? Please please help !!

    Your help would be widely appreciated. Many thanks in advance fellow reclaimers.

    Did you mean interest charged on your monthly statements??? If so, you can NOT reclaim this. The only interest you can reclaim is the 8% statutory interest that the court would award on your charges.
