  • Did you mean interest charged on your monthly statements??? If so, you can NOT reclaim this. The only interest you can reclaim is the 8% statutory interest that the court would award on your charges.

    Thanks for your reply. I understand that now. In this case do i reject the original offer of £316 and again request the full sum of £980 OR accept the original offer and chase for the remainder, £664 ???? It may not matter either way but need to know the best way forward.

    Nice one Laini, although Barclaycard told me in response to my second letter they would let me know by 6 October, I've still not heard. Rung them this morning and got an idiot who said that they were only paying the "goodwill amount" and had written to me ages ago re this. When challenged and asked to write to me in response to my most recent letter he suddenly went quiet and said Oh yes we are still dealing and are waiting on another party to get back to us. I then asked who it was and he said another dept. I've asked them to get back to me before close of business today. Not a happy bunny!!!

    It is personal choice and you should do what you feel most comfortable doing. I rejected my offer of £180 as my original claim was for £700+ and i felt this was a very low offer. My offer letter said that if i was to accept the £180 i needed to sign the settlement form which would close the claim, so if you do accept your offer of £316, make sure that you state that you are willing to accept this as part settlement only and do not sign the settlement form, just maybe write a letter explaining that you intend to claim the remainder via the courts or FOS.

    I would again request the full £980 PLUS the 8% statutory interest (use the calculator on the reclaim page) because they will pay up every penny in the end.

  • :beer: :j Woo hoo, get in there!!! After two letters, one email and three phonecalls I have finally got back what was owed to me from Barclaycard. Spoke to a very nice lady called Carol at Barclaycard Customer Relations this morning - Carol I salute you, you are very good at customer relations - even when I was a bit shirty! Anyway Carol went away did calculations, rang me back within 15 mins and is arranging full refund + 8% immediately.

    Capital One now to finish off. Can go to FOS next Tuesday as the 8 weeks will be up.....

    sent letters, took it to MCOL, said they would defend, 5days later cheque arrived for full amount - £398!

    Result:beer:

    Always go MCOL, have settled every credit card within weeks going this route

    Hi Puffy

    Did barclaycard say they will be sending you a cheque or crediting your account?

    I'va a debt with them that is part of an IVA so am wondering is it worth pursuing if all they are goint to do is credit my debt with the refund?

  • I've also been sent a letter from my County Court telling me to fill in a form N244 and pay £75 to have my 'stay' lifted. I had previously sent a letter requesting this because my claim is for credit card charges and not bank account charges which they seem to have ignored.

    Has anyone else had this letter, or has anyone wrote to their credit card provider first, and not been asked to pay the £75?

    If i pay the £75 will i get this back when the claim is finally settled?

    From reading these threads I was wondering if it is possible to reclaim charges from bank accounts and credit cards that are part of a completed IVA?

    Not directly relating to charges but if an IVA is settled/ completed is the amount that was not repaid ( as agreed) still counted as default account? Am currently needing to review my mortgage as the fixed rate has ended and some of the accounts involved in completed IVA are still showing as default accounts on my credit file. Thanks for your help
