  • Sent off two reclaiming letters - MBNA and Capital One.

    I requested £500 + £178.14 interest off Cap One and they have offered me £210 - have refused and written back saying I am willing to accept £500, if they agree + pay within next 14 days.

    MBNA will respond by end of month, apparently....

  • i am in the process of reclaiming from 6 ccard companies, one of which is beneficial. They have replied to my request for charge details, by telling me as my account has been dormant for some time (still less than 6 years), the majority of the details have been 'purged from our system'. they have sent me partial info from three 'windows' of account history, claiming its the only information they hold. In this info is £60 worth of charges, but i am sure there is a lot more in the whole picture. Any ideas... are they in breach of data protection laws ?... or just playibg hard ball.??

    I had the "purged from our system" reply from beneficial too
    I got even less information on my closed account
    I have reported them to the information commissioner

    I trust they are then in breach of data protection.
    where do i find the address of the information comissioner ?

    I would say they are
    there is a link on the main site on the credit card reclaiming page
    for the information commissioner web site that will give you all the info you need you can also download the complaint form
  • I started the process for reclaiming credit card charges when I first came to know about it (March 2007) and got to the stage where I sent my 2nd letter to Barclaycard. They acted swiftly and cleared my balance of £400 at the time. I (foolishly!!) didn't carry the process through to the end to claim back the full £1,200 they owe me in late payment charges as there was the ongoing court case with the bank charges etc, and I wasn't sure whether that would go in favour of the banks or financial ombudsman.

    I am now at the stage where I want to claim the £1,200 they owe me in charges but need to know where I stand and if I can still carry this through.

    Please help...

    Depends on whether when you accepted the £400 you agreed to cease any further action against them

    Has anyone had to fill in a N244 form to have a 'stay' lifted on a credit card charge claim?

    I'm not too sure what i need to put on the form and trying to contact the Court for any guidance is a joke as it's permanently engaged?

    Any help would be gratefully appreciated.

    I didn't formally agree to it, I realised they had cleared my balance when I received my statement. Does that rule me out of the process, or is it still worth a shot?

  • What I am very worried about is...if I claim back the PPI which I shouldnt have been charged in the first place, would the the card company have the right to demand the remainder of my debt to them in full.........???? Could they turn nasty ???
