Thanks for that info.
My claim started off as a small claim and has now been allocated to fast track. The main thing that concerns me is the extra fee of £600 they're asking for, I already paid the small claims fees. And I'm really not sure why they would want to move it to the fast track.0 -

Sent another one of martins template letters to the HALIFAX as a letter before action.
Got a letter today to confirm they will pay me £919 as a full and final settlement.

How long had your claim been going with MCOL before they paid up? Mines been going for over 7 weeks with them only offering me half of what i'm claiming. Did you have to complete an Allocation Questionnaire?

Hi,
I just received a final offer letter from Capital One for settlement of 314 GBP. My claim is for GBP 1600. However, I have a small question as whether to go to court route or FOS route for my claim.
I live in Scotland, so i can take them to sheriff court for charges from 5 years back which equals to GBP 1300. I believe you can claim up to GBP 3000 in Scotland now.
For the charges before 2003, can I claim through FOS at the same time.
I could claim everything through FOS, however, struggling to pay bills & really need to get my hands on this money asap.
Any advice is appreciated.

Hello Everyone,
Just wanted to let you know that i submitted my claim back in May for Halifax to re pay me £300 plus interest.
They wrote to my on the 29th May advising that they would offer £150 and no interest would be refunded.
I sent a letter back saying that i was not happy with this and received a response yesterday saying that they would refund the £300 plus interest. :jBank Charges refunded from Halifax £2600Bank Charges refunded from halifax joint account £554Credit Card Charges refunded £300 plus interestI'm proud to be dealing with debt!!! :T0 -

Hi It took about 14 days from inital filling in form on the net.....did you do MCOL or did u get the papers form court?

I did it on the internet through MCOL on 15/5/08.
Abbey wrote to me offering half but the only correspondence i have had from the Court is to tell me that an allocation questionnaire has been advised. I have heard nothing from the Court since. I phoned them and they said it's up to the judge as to when he instructs the questionnaire to be sent out, and that's if he does at all!
It seems that there doesn't seem to be any deadline.............although on previous claims i did through MCOL the bank has always offered me the full amount within 28 days so i'm puzzled as to where i stand at the moment?0 -

Put in a claim to court at 6am today copy and pasted the 'particulars of claim' text.
PROBLEM..I HAVE DONE SOMETHING WRONG...I THINK.
I put in the part of how much i im claiming withoutthe interest (£556) but then it said enter the amount of interest calculated with the calculator, i went and enterted the total of it altogether £600 and something...NOT the interest on its own which i think was £132 or something..oh no..i will lose now wont i?
The court thing says its been issued already (same day) theey prob did it at 10 am...not sure what to do if anything?

How easy would you say it is to get CC charges back from Halifax and Barclay card?
I have heard Barclay card can be a right pain?? The total amount will only be a few hundred so not sure I want the hassel....
Any help would be great
