    Hi,

    I could really do with some help on this one.

    I have claim against Cahoot for charges on my credit card, the claim was proceeding through the small claims court but has now been moved to the fast track. They also want a fee of £600!!

    I'm really not sure what's going on, if anyone has any experience in this area I'd really appreciate your help.

    How much is your claim for?

    I'm claiming about £800 from Cahoot (charge was £60) through my local County Court and just had a letter from their Abbey legal dept offering me half of my claim to avoid the expenses it will cost them to go to court..................told them to offer me what i'm claiming and i'll cancel my claim...................waiting to see their next move!!

    I've already been playing that game with them for months now, my claim is for about £1200 they started off offering me a couple of hundred, now it's up to £700 so we're getting closer.

    I'm really trying to find out what the implications of the claim going through the fast track are, should I be doing anything differently?

    fast track cases are generally handled by county courts. Unlike multi track cases, small claims and fast track cases are typically resolved in a relatively short period and in such cases, the claimants are seeking awards that are less that £15,000. Any claimant seeking more than £15,000 will find that their case is suitable for the multi track, as their case may take a considerably longer period for their case to be resolved.

    claimed £537.34 inc interest
    offered £152 -
    wrote back saying would accept £380 (claim minus interest) if paid withing 14 days.
    after 22 days they offered F&F of £380 ,
    Just waiting for the cheque now.

    how long did it take to get an answer from you first letter asking for your charges- then offer - then cheque

    The story:

    23/05/08 Sent letter requesting the last 6 years statements.
    18/06/08 Received statements, totalled up all charges made, not the just the difference between £12 and the charges made. I used Martin's Charge calculator, and included 8% interest for each.
    19/06/08 Sent letter demanding £1454.61 back.
    27/06/08 Received offer from Barclaycard for £357.48 inc. 8% interest
    This was paid into my Barclaycard account, so it was now in credit by £157.48, which they said they would put into my current account.
    28/06/08 Sent second letter accepting part payment without prejudice, but pursuing for the whole amount.
    05/07/08 Received letter today with an offer for a further £894.24 inc 8% interest.

    Incredible result, and took barely 6 weeks to do from start to finish! My credit card is paid off, I don't care if my account is closed, and I still have over a grand to pay off any other debts. Big thank you to Martin lewis and his team at Money Saving Towers, and also to the people who helped here on the MSE forum.

    Now time to hit GE Capital bank...

    hi all

    the amount of cash i am claiming from the Halifax is greater that my outstanding balance.

    Can i insist that the whole amount is paid to me as a chq and not directly on my visa account and therefore putting it in credit ?

    If you go through MCOL (you may need too) then they clear your visa and send you a chq for the remaning amount
