you dont have to send any documents. they have to prove they didn't mis-sell. They will fob you off every way they know how but if you dont get anywhere with the company go to financial ombudsman.0 -

Hi all
Message aimed really to those that have tackled the Halifax for the refund of our credit card charges.
Got a letter from them on the 27th May 2008 offered to refund £260 which is the difference between fee and £12. My claim to them was £960 pounds.
I rejected that offer and sent letter stating so. Called about 2 weeks ago and asked what is happening....They said they had until 9th July to respond to my complaint. Called today ( 8th July 2008 ) and asked what is happening.
Got told that letter is on its way to be saying i can now go to the ombudsman if i want but they aint paying out ! ( thats what i understand anyway ).
Any help or tips from you guys as to what my next move should be ?
Halifax seem to be playing hard ball...Barclaycard were a damm sight more easier to deal with than this lot...LOL

Hi darren.
Once you get the letter, if it says you can go to f.o. treat it as final response and go to ombudsman.
I have had same with capital one and have taken it to ombudsman. it takes a while with them but from reports i have read it rarely fails. Im just waiting on response from cap one now. The f.o. have asked them to reconsider my claim to the amount I am asking for or to provide all information so they can investigate. It would seem these companies dont want investigating so they tend to pay up.

I have had an offer of the difference £20-£12 pounds plus 8% from Barclaycard on 2 cards and they stated that it will be credited to the the accounts.
Problem is I do not have access to the accounts as I sent the cards back and thought they were closed but seems they are not.
As I am going to pursue the rest of the money and send them the "Without Prejudice" letter can anyone tell me if I should ask for them to send me a cheque or new card ???
Any help would be great as I'm a bit lost !!!

I've recnetly got all my money back from Barclaycard (they settled the full amount within 3 days of my second letter being sent) My account was closed, but they still credited the money to the card. The matter was being dealt with by Calder Financial, who arranged the money to be transferred from the closed account to my current account. That goes through within 3-4 days. You could ask for the money to be sent by cheque, but it seems easier if they just transfer it to your bank.

Darren I would try F.O. first. Its free and they seem to be successful. If they cant help you can still go to court0 -

I cant not urge you enough to go this route...
FOS will work but takes an age, MCOL although initially a daunting thought, takes 5 mins to do and with the copy and paste letter, is no hassle.
You should get your money back very quickly and often with companies such as capital one it is the most effective
