  • Hi just wanted to say thanks to Martin as I have beaten the bank!!!
    When I was away at university i signed up to a barclaycard credit card which was supposed to have a low apr but the bumped it up without informing me anyway regardless i missed payments etc as you do when you have the new found freedom. so now im old and sensible i set about reclaiming the charges from 2005 with the help of martin and his templates.
    they charged me a grand total of £292 over that time in over limit and late payment charges, after the first letter they credited my account with £86.00 the difference between the 25.00 charge and the 12.00 it had been lowered to. I wrote back again using martins letters all sent recorded delivery of course and said this was unacceptable and i would settle for £250 and today i got my letter back saying they have credited my account with the remaining balance so i have checked my account and its all there!!! £292 that they charged me they have sent me it all back!!!!!!

    I am over the moon and want to say thankyou so so much to martin!
    It can be done guys, dont settle for the difference in charges, one more letter and you are likely to get it ALL back!!!

    I am writing on behalf of my boss, who has a personal M&S Credit Card. Hopefully someone will be able to advise how best to proceed!

    She did not receive a statement for April, and this only came to light when we received the recent May statement...we pay a lot of bills out of this office and so did not realise we hadn't had the April M&S bill in...anyway on the May bill they of course brought forward the balance overdue for April. My boss ALWAYS pays in full, every month - or did until April! We have now indeed repaid the full balance and the account stands at £0. Because we paid the April balance late, interest has been charged from the date of each transaction (of course it is normally interest free as we repay in full each month). This comes to a whopping £42 in interest! There do not seem to be any late/missed payment charges, and after reading the T&C it seems they do not issue penalty charges at the moment (I'm sure they don't need to with the rate of interest they are charging!).

    What I would like to know is if there is anyway of reclaiming this £42, as I suppose it is not strictly a penalty charge. Both myself and my boss have spoken to M&S in their Indian call centre and both monkey and organ grinder refused to waive the £42, even though my boss is a longstanding customer who spends 2k a month on this card which has always been repaid in full upon receipt of statement. My boss has cut up her card and informed them she shall be closing her account. Is there a way I can get them at all though?
  • My partner has had an MBNA credit card for the last few years. He applied for the credit card and PPI was automatically added to his account, although he may have been given the option to opt out but he says he didnt keep the paperwork from when he first received the card. He has also been paying for separate insurance cover since we took out a mortgage in 2005 which covers for accident and sickness. Would it be worth him trying to reclaim his PPI payments, especially considering he is currently paying over £70 a month (!!!) for this?

    Mmmm, just received half my details today, strangly Capital One did not enclose the details of the month they Defaulted my account.
    HSBC PPI Claimed - £ 2800 -WIN
    Halifax PPI Claimed- ( not upheld by them, issued Court Docs-Settled in full) £4560 - WINBarclays Account Charges- Courts documents issued, Barclays offer me £2000, refuse as I want £5000. Barclays settle day before Court- WIN
    BlackHorse - Court Documents to be issued Tuesday 06 Jan
  • I asked for my cc charges from egg in feb 2007. They sent me a letter on 12 feb 2007 saying that theh charges were legal and why and said 'You now have six months from the date of our resolution to take your complaint to the Financial Ombudsman Service...'

    Can I now still chace that money or have I missed out???

    Can I still reclaim my over limit/late charges if I've defaulted on the credit card and there's still a balance outstanding?

    THANK YOU MARTIN and thanks Moneysaving Experts, Just received a letter from Barclaycard... they have refund me all my charges plus some interest:£475.20!!!!!! Fantastic, I'm thrilled!

    3 more reclaims to go:

    1. PPI on my Barclaycard
    2. Charges on my Capital One Card
    3. Barclays bank charges

    I didn't think it'll work!:T :T :T :beer:

    just a quickie..i was wondering if anyone could help me with capital one..

    i had a £200 credit limit on my card ... to cut a long story short i got charges after charges and it went up to £400 i paid £200 and due to very very bad finacial problems i couldnt afford to pay the rest and buried my head in the sand ( i know i know bad me lol) anyway they took out a ccj against me ...do u think im still able to get my charges back?

    and would it be cheaky to then get rid of the ccj as i actually paid them the money i spent it was the charges that me the ccj
