darren i would say go for the full amount. you can always change your claim and ask for the charges minus this interest at a later date. Plus, if you go through the courts or FOS you will get the interest back anyway (more than likely!)

I would defo say go for the full amount Barclaycard would go after your money and charge an extra £25.00 if they thought they'd get away with it! (which they have and that's why we're here in the first place!) so you go for it i know I'm going to once i finally recieve my statements that is!

By the way can anyone tell me how do I find the template letter to threaten Barclaycard and Barclays that I'll go to the FSA if they don't reply within the next 7 days because their 40 days are up tomorrow and I haven't heard a thing from either of them but both have taken the £10 fee!!! the flamin cheek!

also I've read someone has claimed against Studio and Simply B, so does that mean I could claim against Fashion world? If so, does anyone know how i go about this? Any info would be much appreciated, thank you.
A MASSIVE Thanks to all you fantastic people who post the comps and answers:beer: :T

I am having a bit of a mare with Natwest trying to get my charges back, i've wrote to them 3 times and onthe first occasion they put £126 into my account, then after the 2nd letter, they added another £18 and after the third they put in another £136, i ideally want the full amount (£735) or as near to that as possible, but this is turning into such a slow process. Anyone have any advice on what i should do next? I have spoke to the FO and they said to get back in touch with them once i have my final offer, but that seems like its a long way away.

I had 5 credit cards but, through no fault of my own, could not keep up payments on them and had numerous charges. I have since had to take out a loan to pay these cards off because of the threats of court actions. My problem is two fold. Firstly, I have got rid of the cards and all statements I had so I do not know the account details to enable me to claim charges back & when I settled the accounts I was given final settlement figures which were less than I originally owed.
Now do I proceed with charge claims or is that being to greedy?
Do I send a letter to the banks asking for my details even though \I do not have the details?

You are entitled to late payment charges and overlimit charges plus interest - if you went over your limit at any time then you need to know when and how much you were charged.
You could write again asking for all information on your account as set out in Martins first letter
    Hope this helps.

many thanks for your reply, i will crack on it with, cheers

Masseeh just wanted to say congrats on at least getting a response from them!! I have sent the letters (and threatened court action!) and i havent even got a reply! Going to call them now i think. I would go to the FOS if i were you. i have called them about GE and Mint and they were more than helpful.

    Thanks for the reply Monica

Hmm, i cant believe they havent replied yet, what address did you send it to? I havent replied to HSBC yet about accepting/rejecting their offer and they have already paid the money into my current account (I closed my credit card last year so they cant refund to it directly).

I think i'm going to claim at the FOS for the remainder of the money.

well, i called them on Friday and they said they werent going to refund anything and a letter had been sent out to me. I told them i hadn't received anything and asked them to send me a letter with a ref number so i can contact the FOS.

Today i got a letter thanking me for my phone call and they are re-investigating my complaint and will contact me again once they have completed their investigation.

I would proceed through the FOS. I did that with Mint and got a fab response! Good Luck Masseeh!

    Hi there

18th Feb 2008 Wrote requesting details of charges applied to my account
16th Mar 2008 Received full break down of charges applied.
31st Mar 2008 Wrote requesting CO to repay £774 plus interest - £1105.75
7th Apr 2008 CO offered £208 goodwill payment
11th Apr 2008 I replied saying I accepted the offer without prejudice but stated that I intended to pursue my claim for the full amount plus interest.
24th Apr 2008 CO replied saying it would take some time to review.
14th May 2008 Final offer letter saying they would oly pay £208.
5th May 08 Filed a claim with the Financial Ombudsman
14th May 2008 Once again told Capital One that I would accept their offer without prejudice.

    Today, 27th May

Received another letter from Capital One stating that they are unwilling to budge and their final offer is £208.

I still haven't received the £208 which I have agreed to accept without prejudice.

Should I leave it in the hands of the Financial Ombudsman now? Do i chase up the £208 payment in the meantime

    Please advise

jo if your case is in the hands of the FOS i would call them and see if they have heard anything from CO about your claim. Also mention that you accepted £208 as a partial settlement without prejudice on 11/4/08 and you havent received your cheque. Also if it were me i would call CO and reiterate that your complaint is in the hands of the FO and that you are still waiting for a cheque for £208. Mention that the FO is aware of this outstanding payment.

Sorry unsure what else you can do.
