I defaulted on my cards a few years ago and made the mistake of attempting to pay them off through Spectrum Financial Protection. Since speaking to CCCS last year I stopped doing that and intend to declare myself bankrupt soon as I have the funds to do so. The reason I defaulted is actually due to a bank error far to lengthy to go into now, but in short I live abroad now and CCCS have advised me since I have no assets there is little anyone can do short of wait for me to return to England and file bankruptcy.
Question is, am I able to reclaim the hundreds of pounds (around 600) I was charged by the credit card companies for missing a payment? The bank error which caused me to miss a payment on several cards caused a late payment fee and hiked up my interest fee an enormous amount, which in turn hiked up my minimum payments and the whole thing quickly went from being manageable to being utterly unmanageable, hence my decision to approach Spectrum and try to reach a settlement with the card companies.
Since I am no longer paying them as I'm waiting to declare bankruptcy, is there any chance I can attempt to reclaim these fees?0 -
I have complaint baout mint to the FOS, I received a letter from the FOS stating they have got my form. However 3 weeks have passed and I still don't hear anything from them or mint. What is the average time in which they will answer to my complain?
Thank you0 -
Provider: MBNA (Abbey Credit Card)
Amount Reclaimed: £3108.15
Amount they paid: £2560 so far!
The story:
I had a nasty car accident 5 years ago & was unable to work for 3 mths, I contacted MBNA but they woulndn't help me, the charges then snowballed, first for missed payments, then the overlimit charges, In August 2007 the account was seriously over its limit (I havent used it for 5 years!!! & only missed 4 payments 5 years ago due to the accident) I had been hit with overlimit charges, late payment charges and the odd 'non sufficient funds' charge every month for 5 years!! (despite not having a card or trying to use it!) hence the recaimed amount of £3108.15 inc interest.
I wrote to MBNA on 8th August 2007 & recieved a reply 4th September 2007, this letter advised all the usual blah, Charges fair & transparent etc, 2 lines at the bottom advised that as a gesture of goodwill my account credited with £1048, but arrears still stood so charges will continue, I used the template letter on 8th Sept stating that I had not recived a satisfactory response so would issue proceedings. On 27th Sept I recieved another 'charges are fair letter' but advising a further £1512 has been credited to my account.
This has been so easy - thanks Martin!!
I am going to try for the remainder of the reclaim as MBNA have been so indiferent to my circumstances & I have continued to make payments of £115+ for 5 years & until now owed them a horrendous amount of money that I have never actually spent on the card, the 8% interest I have asked for is a drop in the ocean compared to what they have charged me in interest on all the charges they have added.
Going for Capital One for myself & husband next then Halifax for my husband

i am confused about repayment cover on credit cards, i got a credit card in sept 2004 and wasnt sure about cover and so presumably took it out without knowing too much about it.i am self employed and looking through the policy and if i was employed they would pay out from 30 days but being self employed have got to cease trading and not be in work for 6 months.i am still working but now paying about £35 per month on this cover.what should i do?0

bailey if you go on the Loans board you should get some answers in the 'PPI Discussion' thread but i think you could reclaim that based on your info. However check with the folk on there as they will know for certain.
Owtfornowt yes you can reclaim these. If you still have your cc be aware the amount you reclaim will more than likely be added to your card and reduce your balance but you will still be benefiting azs your debt will be reduced. If your account is settled you should receve the payment by cheque/bank transfer.
Hope this helps
