  • Which letter do i use to say i accept their partial payment but still want to claim for the rest?
    I need to start saving so I plan to save £2 a week to start with:beer:

    which stage are you at brunettegirl? If you have received the offer after the first letter (as i have) i think the next letter is the letter before action (LBA). I would send that but state in that letter that you accept the offer of £51.84 as partial settlement without prejudice and you will be pursuing the rest of the claim for £x plus statutory interest totalling £x (if you claimed it in the first place). Before you do this though i would confirm with barclays that this payment is a reimbursement of charges.

    Hope this helps. I have to be truthful, as i havent got to the LBA stage i havent read the template so not sure whether this wording (or something much better) is already present. Hopefully someone who is of more help will be along shortly!

  • Thanks Monica, I have sent the first letter, I had no reply but have discovered credit on my account today. I will call them to check that is what its for - very sneaky of them to just credit the account and not say anything! and amend the second letter.

    I applied to barclaycard for a refund of £354.74 today I have discovered they have recredited my card account with £51.84, this is the first 4 months when they were still charging £24. Can I still write again to ask for the rest or should I be grateful with what i have recievied????

    I'd ask for the rest but its entirely up to you. I have just successfully reclaimed 400 and odd quid off barclaycard including interest. First they offered me about £160 then after the second letter they offered me the rest. Go for it, good luck!

I am writing to inform you I intend to claim the full amount claimed together with interest up to the date of judgment and court fees in the proceedings through the county court. <O:p></O:p>

    This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the court will rule in my favour. As I am sure you are aware, the Office of Fair Trading also stated in its April 2006 statement into credit card charges that it considers charges are at a higher level than is legally fair.<O:p></O:p>

    That's the 2nd letter i sent to both MBNA & Barclaycard and i was successful at getting all my charges back. Tesco, Egg and Cahoot are not playing ball though and i've had to refer my claim to the FOS. Good luck!

  • I am currently re-claiming natwest credit card charges totalling £323 this is made up of 11 £20 charges the rest is £12 charges and interest.I recieved an offer of £88 -the difference between the £20 and the £12.I sent back the *accept without prejudice* letter.Today i recieved a phone call from natwest credit cards telling me that £88 pounds has been credited to my account along with a futher £7 interest,the lady said that this was all they were prepared to do.Any advice on what to do next would be greatly appreciated.

    its entireley upto you. If you think £88 is a fair amount then accept. If, however you want the full amount then write to them again stating you accept this amount as partial settlement without prejudice and you will be initiating court proceedings or taking your claim to the FO if settlement for the full amount isnt made within 14 days. If they do not respond or do not pay up initiate court proceedings straight away as you they have been forewarned.

    If it was me, i would not accept this amount. But its your claim and £88 is still money you thought you would never see again.

    Now im quite new to this whole reclaiming thing, but I have never seen or heard about citibank winning a case (as far as i know the oft never actually said £12 was fair, they simply said they wouldnt investigate banks that charged this amount but i could be wrong). Im sure someone would have posted this on here if it were true. Plus people on this board have claimed the £12 charges back and won both in and out of court so i cant see citi's argument holding water. Its upto you whether you wish to proceed with your claim. Its money thats better in your pocket than theirs. dont forget to add the interest :D
