Is it possible to claim when in an IVA? or is this not wise?

Claim away!!
I've had nearly £6k back in charges and they were all sent to me by cheque. ( The easiest ones were A&L and MBNA). Obviously your meant to claim any 'windfalls' and pay them towards the IVA but it's hardly a windfall when it was originally your money.
I'd love to see someone take their IVA provider to court to argue the case of a 'windfall' as i'm sure they would lose.
Having said what i've said about receiving cheques, last Friday i received a letter from the Co-op saying they are repaying my charges (£451) but will be paying it towards my debt and will be informing my IVA provider.
I'm about to complain because it's a condition of my IVA that all monies paid into the IVA should be spread equally between my creditors, so surely the Co-op are acting illegally??

They owe me £12 x 2 on my citi bank credit card for late payments. I no longer have the account opened ie I don't use the card since 2006. Sent off first letter asking for refund of these 2 charges...It's only £24 for gods sake! After 12 weeks....they are the slowest ever in replying and 3 letters in the meantime asking them to send me a reply or else, I have today received a bog standard letter saying that they have followed the OFT guidelines and reduced their charges to £12 and also that they have successfully argued this in court and WON and therefore recommend I do not do anything more on this as if I was to take them to court I would lose due to their already successful court win...
Now I can't recall Citibank wining any court thing about their £12 charges....Does anyone know anything about this case or is this a bog standard letter saying go away and trying to scare me........It's only £24 for petes sake and I am getting really angry at their atitude. In fact I have just checked and they owe me £2 anyway since 2006 but no mention of that in their letter!!:mad:
Any one have any ideas? I am now tempted to take them to court regardless of them wining a court case or not!!!

well mint called me at around half 11 to discuss the letter i sent to them about reclaiming my charges. As i was at a mother and baby group i couldnt discuss it so i have asked that they call me back at half 1. Is it normal for the cc people to call? I thought it all had to be done in writing?

I applied to barclaycard for a refund of £354.74 today I have discovered they have recredited my card account with £51.84, this is the first 4 months when they were still charging £24. Can I still write again to ask for the rest or should I be grateful with what i have recievied????I need to start saving so I plan to save £2 a week to start with:beer:0

ok so mint called me back stating that the OFT declared the £12 charge as fair so i will not be reimbursed for those charges but they will refund the difference between the old £20 charge and the £12 charge plus statutory interest. So i am receiving a cheque in the post for £34.56.
I asked them to send me a letter detailing how they come to the £12 charge which i would send on to the FO to deem whether it is actually fair or not and the woman i spoke to said they wouldnt. I said in that case i accept the offer of £34.56 without prejudice as partial settlement and will be pursuing the rest of the claim. I also asked her to add the latest charge to my claim bringing it to £386.64 in total which she has done and said i am welcome to pursue my claim. I confirmed i would send another letter detailing this once i had received the cheque from them.
so far mint have been surprisingly quick with my claim we'll see how quick they are now.

Very interested to know how you get on - got breakdown of charges from Mint - they charged OH £36 (3 x £12)- not much I know but still I want it back!!!!
From my reading here, doesnt seem that peeps have had much luck with £12 charges but maybe I am just reading it wrong

RMC people havent been successful in the first instance but at the end of the day a claim is a claim and its your money. Dont forget to calim the interest too using the calculator on the credit card reclaim article. As far as im concerned the fact that they cant/wont prove how they apportion the £12 charge proves it is disproportionate so i want my money back! Pursue your claim! Let us know how you get on.

PS mint have been quick as far as im concerned but not sure if ive just been lucky.
Edited to say that while people havent been successful after the first letter often it is resolved by the time the claim reaches the courts and people have received the charges + interest + court costs.0 -

The sample letter doesnt really deal with the £12 issue - are you using another template to contact them again - I am PETRIFIED of going to court - which I have just realised is a bit stupid since I attend Youth Court (as part of my job) almost weekly!!
Must agree with Mint being the quickest - also contacted MBNA, Barclaycard, First Direct and Sky (OH had loooooooooottttttt of CC and was so bad at paying on time!!!) Two have cashed cheques but no statement yet. Personally I want MBNA the most - they have been terrible to deal with before balance was cleared and this month sent a statement for 9p?????????????????

ok as i have some chargesfrom before 2006 i used the paragraph which stated that the charges prior to 2006 were unfair and added to the end of that paragraph 'just to clarify, i wish you to reimburse the charges for £12 also as these too are, in my view, disproportionate and unlawful'. I think if all your charges are for £12 you cut the paragraph out and use the rest of the letter. Not sure though someone else may be able to clarify this.0
