    If the card is in debt then yes they will put any monies reclaimed into the account. If it isn't in debt then you need to write and close the account and ask for a cheque for the credit balance.

  • I live in Spain and have been fascinated by the goings on with the banking reclaims going on in England. I am constantly being charged €30 late charge on my credit card for an amount of €60 a month for being one day late due to my pay check going in late. I therefore am paying €90 a month, I have written to the bank spoken to the bank who say it is the credit card not their fault. I also asked my bank for a credit card statement for the last three years because on my visa card because again they were charging me different amounts each month although I was supposed to be on a standard €100 each month on €1000 maximum. I actually put €700 back on to my card and yet when I missed two payments because I was on holiday they cancelled my card yet in reality I was 7 months ahead on my payments. I wanted to see if my statement showed me these payments but they took my visa offline so I could no longer see my statements. I have been asking for nine months now and can get no response either from Visa or my bank. My question is - do anythings that Martin has started with the Law Courts apply to Spain and the EU or is it just applicable to UK. I am a pensioner and this is affecting me a lot.

    You need to claim via the credit card company but do be aware than any monies reclaimed will be put towards the debt no matter who holds it but this of course will reduce the total of your debt.

    I've won charges back from MBNA, Alliance &Leicester and Abbey and am currently on an IVA and all the refunds were sent to me in the form of a cheque so don't worry about it clearing your debts as they didn't do that for me.

    My accounts are obviously closed as i can't use them so i don't know if that was the reason for them posting me the cheques, but my debts totalled £15k between them and i won back £6900 so don't give up!!
  • I am currently waiting for my second replies from MORGAN STANLEY & BARCLAYCARD. I requested for £600 from Morgan Stanley including interest and they offered me £192, i also requested a similar amount from Barclaycard and they offered me a silly amount of £80 plus 8% interest. I dont think so!!!
    Unfortunately, i ended up accepting £268 from Capital One which i think was a bit tight as the charges equalled about £1000 but i wanted to clear my credit card balance and have ended up with a nice cheque being sent out to me soon.....

    (Debt Jan 2014 LBM £34,000) Current 2016 "Problems" as follows:

    C Cards 1,2,3,4 WAS £18,333 NOW£0 :j...Overdraft WAS £2700 NOW£0 :j
    Secured Loan
    WAS £4113 NOW£0:j.......Loan WAS £8864 NOW £6,000

    DEBT TODAY = £6,000
    (£28,000 PAID OFF SO FAR!)

    I would like to start the process of reclaiming charges on my Lloyds TSB credit card but I'm unsure of the address to send my SAR letter to. So far I've found two possible addresses:

    Swallow House
    10 Swallow Street
    Birmingham
    B1 2AL

    and

    25 GRESHAM STREET
    LONDON
    EC2V 7HN

    can anyone confirm which address I should be sending it too?

    That sounds great as most of what i owe is due to fees, one problem now i can't fine the addresses for Barclaycard, monument & Citi cards, can anyone helpaction-smiley-033.gif
