I've got over limit charges on my account from May 07 to Feb 08 all at £12 a month - can i claim these or am i just being greedy now?
  • Hi,
I have been declared bankrupt and am now out of my terms of bankruptcy. Could i reclaim charges on credit cards and bank accounts that have been settled and closed due to the bankruptcy?

    Thanks, any advice appreciated!

I've made a claim to a credit card company regarding charges and i recently received a letter back offering a goodwill gesture offer of £400 when i was claiming about £800 plus some interest.

I sent one of martin's template letters to them and included the bit to say 'i acknowledge and accept your offer of £400 as part payment only' but i want the rest bla bla and you have 14 days to reply. However, i didn't include 'without prejudice' and i've read a few thread's now where people say you should put 'without prejudice' when refusing a goodwill gesture.

I've not yet had a reply but am a little bit worried. Could me missing out 'without prejudice' make any difference to them giving me the rest ??

    Hellew,

Was just wondering if anyone has had dealings with Monument or EGG? How x hard is it to obtain money from them? They both owe me just over £500 including interest, which I have added on using the template from this site, just got a letter from Monument saying the apparent usual blurb that they think their charges are fair and under terms and conditions it says this etc etc. So Im sending them a letter telling them I intend to go to court. Does this usually prompt them into paying at least majority of what they owe? And does anyone know what tactics EGG will use?

    Thanks for your help

Sorry, no experiance with Egg but recently wrote to Monument requesting they pay back £800 in charges and interest. They replied offering £330 which i refused and they replied saying that was their final offer.

I have just sent off the forms to the FO to see where that gets me.Hope this helps.

  • When talking about credit card charges is this just for credit card or does the same system apply to store cards
  • Has anyone had much luck with Cap1?

i wrote requesting list of charges on the 17/02 - replied by 03/03
    Refund request letter sent 06/03 £296 - replied offering £88 17/03
accepted without prejudice, and advised i will pursue this further 18/03 - gave 7 days to respond, havent heard yet but it was a bank holiday so will leave it a bit.

After reading some threads on here get the feeling this will be their final and only offer - any thoughts please?

    Hi everyone,

had an offer today of 120.00 from the halifax
Asked for 472 this includes interest

seven of the charges were for 12.00

i am thinking of pushing for the whole amount anyway

has anyone else done the same and been successful?

Thanks in advance for your help

    Hi All,
I wondered if someone would be able to give me advice. I am currently helping my dad sort out his debts. The majority are on credit cards, 1 of which has recently taken him to court and another is threatening it. However, would it still be advisable to try and reclaim the charges he has incurred on these accounts or would it be likely this will make the companies that have agreed to nominal payments to suddenly demand payments in full?
He has received HUGE amounts of charges which would help lower the amounts he owes to these companies but I am worried this may stop them being reasonable!!
Any advice would be hugely appreciated!!!!!
Also, all the credit cards are now in th hands of debt collection agencies, is that a problem? Or would we still write directly to the credit card companies?

You can start claims and they would be direct with the cc companies rather than the DCAs but yes if they have agreed to freeze the interest or similar they can stop that. He should keep paying even a nominal amount per month and if he is hassled by the DCA should say to them that the account is in dispute at this time but he can of course only say this if he starts a reclaim. At least get him to make a start by getting the statements and checking out what charges he has.
