Quick question re credit card reclaiming charges. I have already sent letter 1 and 2 ref the original templates. Just received another letter from credit card supplier which more or less infers that any charges incurred were totally down to me as "payment date, charge etc were clearly stated", which I am assuming is their way of getting out of any refund etc. Stating OFT statement etc. Do you think it worthwhile to send 3rd letter threatening further action or do you think I am on a losing course here? Any help or assistance would be appreciated as this is the first time I have attempted anything like this. Many thanks

I've had a mixed response. A&L sent a goodwill gesutre after letter 2. Beneficial Finance have said NO WAY, it was my fault etc etc after the second letter so i've sent them the third. Not had a response yet, but i only sent it a week ago.

    hi folks,
    hope someone can help
erm... i sent my first reclaim letter (from a template here) to Barclays well over two weeks ago, which i believe is to be the deadline of contact for them.. is this a common thing or do i write a second letter?
and i sent it to my local branch...was that a mistake too? should it be Soho square or something?
    any help appreciated thank you.

I would send another letter and threaten with court action if you think you want to get your money back and yes do go down the route of the OFT after all they will be on your side, the bank is just trying to fob you off so dont give up;)

Hi, i've had a good will gesture of £180 from beneficial finance. the letter they sent stated

"The payment is being offered on the basis that you are agreeing that you wil not make any further claims or take any legal action on this matter. This gesture of goodwill is with out prejudice to our right to impose and recover default chagres in the further. If you agree to our goodwill payment, i would be greatful if you would sign and return the enclosed exceptance form. upon receipt i will be happy to issue a cheque for this amount."

Now - does this mean, if i choose NOT to accept i won't get the good will payment?. This is only 36% of what i'm asking for!? Advice anyone please.

you do not need to accept this goodwill gesture if you do not want to. by signing any paperwork and accepting said offer, you will not be able to chase up the rest, this tactic is usualy used to stop you claiming full amount, I had similar offers from the halifax who after 3 go's accepted my request to repay full amount plus 8% interest as requested, with one downside they would only pay the money back into my account, which would not have made much difference to the amounts owing. Due to this i have complained to the OFT about it and await their decision. so you can reject the offer and go all the way if you wish to,at end of the day you will be no worse of than you was before you claimed.

    tried to claim back £220 from Monument (4 x £25 and 10 x £12)

they offered £50 but I rejected it and they have now give thier Final Responce of £50 - in the letter it said if I no longer wished to abide by their terms ans conditions i was welcome to close the account and repay the balance (which i cant do!)

    any advice anyone - pleeeese!!!

if you beleive that their offer is final and you may not get back all you asked then you should complain to the ombudsman,i have issued two complaints to them one regarding PPI and the other regarding the halifaxs refusal to pay me what is owed by cheque, i do not want it going back into my acount otherwise i lose out. you could try again and say you are not accepting their so called offer as it is nowhere near what you are claiming, do not forget to add 8% interest to what you are claiming which is the amount courts would add to your claim. this is just one suggestion others may have other ideas, but do not give in to them.
  • Hello
Just recieved letters from MBNA (which was returned to me within the 14 days) from which I had requested the money from 2 credit cards, they have put that they are investigating the claim and have said "they will provide me with a full responce by April 03 2008".
I actually am claiming for 2 credit cards that I am paying off via CCCS as I got myself in debt over 3 years ago, but as I say there credit charges did work against me and put me more in debt.
Is this why they are investigating the matter?
Can they do this to me?
    Please can somebody help me?
    Thank You

I have recieved letters from MBNA which yes they replyed within the 14 days but they have put that they are investigating the claimand they will provide me with a full response by the 03 April 2008.
I am actually claiming for 2 credit cards that come to above £1200 plus the interest, but these are cards that I am paying off by CCCS, could this be the reason they are are investigating the claim?
    Please can someone help me
    Thank You
