i put in a claim with the halifax for reclaiming my charges, they offered me a goodwill gesture which i refused, they then updated my offer but i refused it. after a while i got a letter saying they will pay back all my charges as per my request, but they would only pay it back into the card account, i refused to accept it and have made an official complaint to the ombudsman, i just have to wait now for an outcome. :D

Hiya all, Just after a bit of advise really, i have sent a letter of to Barclaycard, reclaim £480 of unlawful charges + 8% interest on top. They have replied, saying out of a good will gesture they will pay me £192 odd + 8 % interest. Do you think i would be able to get the full amount from them?

Thanks

Wolfe

In a word.........yes - I got every penny back from them.

Good luck!

Hiya Angelwillow, thanks for your reply, what step/s did you take after they made an offer to you, as am not sure what i should be doing next?
• Received a letter off Barclaycard this morning saying they are going to credit my account with £1140, I rang them up as i did not want it credited to my account i wanted it as a cheaque, they told me they were taking all the money for my outstanding balance can they do this ????
they said that because i havent made a payment to them since january 2007 that they are within their rights to do this.
they said that for the remaining balance of £259 they will pursue me with debt collection.

• This is my very first time at posting, so please forgive if I'm in the wrong place, (and direct me to the correct one please!)
After telling Barclaycard that I wouldn't accept their first offer of the 'difference' and asking if they would write off my higher Mastercard balance instead, I have received a reply which says they are sorry I am not satisfied and they aim to resolve matters by April 8th 2008.
Please does anyone know if this date means anything, and any advice re should I wait, or just press on and threaten to sue?
Thanks. M.

hiya pennymore just hang in there, I recentlly wrote a letter to my credit card asking for around £1,000 in charges to be refunded, they sent a letter back saying they would offer me £350 goodwill gesture which I refused and sent another letter back "Without Predjuice" and they sent another back saying they were sorry that I was not satisfied and there complaints department was dealing with it, I got a letter last week saying they still did not agree with my complaint as I had signed an agreement when I took out the credit card but as I am a loyal customer they were offering me £960.00
cant complain about that :T so fingers crossed your bank will do the same

Dear Sir or Madam,

Account number:
I refer to default charges applied to my account amounting to The charges total( £insert amount) plus as I believe I have been unlawfully deprived of the money I have calculated( £insert amount)interest at the statutory rate, the amount the court will award. I therefore ask that you repay me the full amount of £your total amount)

I wrote to you on (insert date of first letter) making the original request for a payment in settlement of my claim. As I havenot received a satisfactory response, I am writing to inform you I intend to claim the full amount claimed together with interest up to the date of judgment and court fees in the proceedings through the county court.

This is based on the Unfair Terms in Consumer Contracts Regulations, as I believe these default charges are unfair and not proportionate to your costs, and therefore the court will rule in my favor. As I am sure you are aware, the Office of Fair Trading also stated in its April 2006 statement into credit card charges that it considers charges are at a higher level than is legally fair.

Without prejudice
the charges and interest I have claimed above total( £amount. ) However, if you are prepared to pay to (insert original amount without intrest )within 14 days of the date of this letter (and, for such purpose, time shall be of the essence), I am prepared to accept this lower figure in full and final settlement of my claim and interest.

I will accept (£original offer) as partial payment of the final amount.
I look forward to a full response to this letter within 14 days, otherwise I will commence court proceedings to reclaim my money.

Yours faithfully,

hope this helps this letter should be sent after the offer of a goodwill gesture which you refused but ask if the bank will offer it as part payment of the final settlement and please make sure you use Without Prejudice in your letter
• Quick question re credit card reclaiming charges. I have already sent letter 1 and 2 ref the original templates. Just received another letter from credit card supplier which more or less infers that any charges incurred were totally down to me as "payment date, charge etc were clearly stated", which I am assuming is their way of getting out of any refund etc. Stating OFT statement etc. Do you think it worthwhile to send 3rd letter threatening further action or do you think I am on a losing course here? Any help or assistance would be appreciated as this is the first time I have attempted anything like this. Many thanks
