    I have rejected 2 offers from the halifax, 1 was the amount offered was nowhere near the £160 that i was claiming, 2nd was i was not happy with halifax wanting to repay the money into my card account,especially as the amount i was claiming is less than the £130 interest i am being charged each month. I have made an official complaint to the ombudsman about this problem, because i beleive that it would make no difference to my account balance,also if they paid back into my card account,then the bank has not really paid the customer back.:cool:

    You can ask but generally they will only refund to the card if there is a debt on the account which of course will reduce the amount you owe them

    Two different replies from the FO to MSE Wendy...

    I've just called the FOS press office who has said that yes the consumer has the right to ask for the money to be refunded how they want it.

    However, she also thought that the bank could come back and say no, and is checking where consumers stand when this happens.


    and the second, in my opinion, covers what you call compensation....

    "I have checked with a colleague who has said that in fact when a bank or credit card company are refunding the full amount of charges they are generally able to pay it into the account that incurred the charges. The logic behind this is that generally when resolving disputes if we uphold a complaint we would ask the firm to put the consumer back in the position they should have been if things hadn't gone wrong. Therefore, if we found a charge should not have been applied or a bank or credit card company has offered to refund the charges they can generally re-credit the account the charges were applied to."

    As above, the company does not need to pay the customer back but they are obliged to put the customer back in the position they were before the charges were applied.
  • Hi New to the forum but not the website. I managed to reclaim £3,000 back in bank charges last July from LloydsTSB following Martin's guide. Thanks Martin.
    I am currently claimimg back £1,275 from MBNA Abbey c/card.
    I have received a letter back saying they will review my case and will contact me by 9th April with their response. I am sure it will be their standard good will gesture for the equivalent of a happy meal so obviously i will accept but still push for the rest. The thing is i had quite a few £12 charges in there too. Are they paying these £12 charges back or are they dragging their heels with these since the FOS ok'd £12?

    I've sent my letter to A&L claiming back £61 on the 10th March, giving them 14 days to reply as per Martins template..............they replied saying the are looking into it and will reply by 4/6/08?!?! WHAT!! thats nearly 3 months? surely they can't do that

    This is really annoying me! I'm reclaiming for about 10 credit cards at the moment - all of which i had when i lived at my parents house.......i have since moved into my own place, therefore i am putting my current address on all correspondance to the banks, so why oh why can they not reply to me at my current address as my letter states?! they reply to my old address...........i'm just lucky my parents still live there!! Feel better for getting that off my chest.

    Response received advising they will NOT be upping their offer of £88.00 - FOS here i come!

    Beneficial Fin CC - Claiming £490

    Accepted with out prejudice, but pushed for full amount.
    LETTER RECEIVED OFFERING £490!! RESULT :rotfl:

    Barclaycard 1 - Claiming £69 Await Response
    Rang up chasing response - they apparently have NOT received my letter - likely story! Sent again recorded this time
    Goodwill Gesture offered of £25.92 as full and final offer
    FOS here we come

    Barclaycard 2 - Claiming £485.75 Await Response
    Goodwill Gesture Offered £150.12 as full and final offer
    FOS here we come

    Mint - Still await statements

    Halifax - Claiming £121.71 await response

    Virgin CC - Claiming £160.00 await response

    Lloyds TSB - Still await statements
  • Here is the story so far:::

    Provider - Capital One
    Claimed - £1064
    Got - £268 :mad: (did send another letter asking for more but they refused and we thought this is better then nothing)

    Provider - Morgan Stanley
    Claimed - £600
    Offered - £192, second letter sent back saying this is not good enough so waiting for next reply.

    Provider - Barclaycard
    LETTER SENT FOR COPIED STATEMENTS ON 22 JANUARY, SENT ANOTHER LETTER END OF MARCH SAYING TIMES UP AND STILL NOT RECEIVED A REPLY. WAS TOLD OVER THE PHONE THEY WERE BACKDATED WITH REQUESTS!!!

    We are going to keep trying and see what happens but something is better then nothing as they say!!!

    I recieved my first offer letter today - from capital one - they offered £132 as a 'goodwill' gesture. My original claim was for £314. Should i not be greedy and just accept their offer? Any help would be much appreciated. :p

    barclaycard - 5,580.00
    capital one - 1,700.00 :eek: scary stuff, but im determined to be frugal and pay off my debts xxx
