  • Hi, I'm new to this so I hope I've done it properly! What I need to ask is can I claim back credit card charges that were only £12 per charge? I've calculated that barclaycard owe over £300 but they have sent a letter back offering £24 as a good gesture as this is the difference of the charges incurred before the current £12 fee.
    Do I carry on regardless and send the next letter?
  • Hello everyone, I have been trying to claim £510.84 from HFC. I have sent the two letters. They wrote to me on 2 January saying they would offer a goodwill payment of £60. There was a signature required saying that I would settle. I didn't. I then followed procedure and wrote to the FOS. I have received a letter from them saying that I need to write to HFC if I am unhappy with their response. I do not know where this sample letter is. Am I being a bit thick? Could you let me know the next step as I am afraid that it is going to fizzle out. Thanks in advance.:confused:

    Not sure about the link for the letter, but reply to them and accept the money as payment without prejudice. I have already dealt with HFC and they paid the lot £595 on receipt of the 2nd letter. Only downside was there was no interest. Anyway received all my cash back witout much of a fight.

    Hi. I am chasing the halifax for a refund,I also had a letter making a goodwill gesture,I wrote back refusing it, I then got a letter stating they would pay back what was asked for plus interest. The downside to this was they want to re-pay the amount coming to over £134 back into my card account, so i once again said no i would like it in the form of a check. I am using Oasis Financial to do this for me so the bank can not try to twist my arm. I saw a post on this website that says i can as for the money how i want it, because it is mine and i can have it how i want. You do not need a sample letter to reject the offer, just write and tell them.

    I've just called the FOS press office who has said that yes the consumer has the right to ask for the money to be refunded how they want it.

    However, she also thought that the bank could come back and say no, and is checking where consumers stand when this happens.


    and the second, in my opinion, covers what you call compensation....

    "I have checked with a colleague who has said that in fact when a bank or credit card company are refunding the full amount of charges they are generally able to pay it into the account that incurred the charges. The logic behind this is that generally when resolving disputes if we uphold a complaint we would ask the firm to put the consumer back in the position they should have been if things hadn't gone wrong. Therefore, if we found a charge should not have been applied or a bank or credit card company has offered to refund the charges they can generally re-credit the account the charges were applied to."

    You can ask for a cheque but at the end of the day you'll find its up to the bank/cc company as to how they repay you and as you are using a company for your reclaim you'll find that they will charge you their percentage no matter how the claim is repaid.

    They get 40 days to send the statements to you, if they dont you then report them to the information commissioner. Hope that helps.

  • Help and advise please. wrote to Cap 1 asking for £484 back in charges. They have wrote back saying i can have the diff between £20 & £12 as they claim the OFT hasnt challenged them on FEES and as a gesture of goodwill they are offering me £112. Do i accept or challenge? If i challenge what is the best course of action?

    Hi all,

    Currently trying to get charges plus interest back from Barclaycard using the templates on this site.

    They signed for my first letter on 30th Jan and I got a reply back on 7th Feb where they offered to pay the difference between the charges and the £12 rate, plus the interest.

    I replied using the 2nd letter stating that their response was not satisfactory and that I intended to claim all charges plus interest in the courts, stating that I expected a full response to my letter within 14 days, otherwise I would commence court proceedings.

    Barclaycard signed for the 2nd letter on the 11th Feb, it's now the 27th of Feb and I still haven't recieved a reply.

    How do you advise I proceed with this one?
