  • i got 2 cheques in the post today from mbna for my claims on my 2 old credit cards accounts.
    i claimed £475.66, they sent cheque for £136.61 and the other claim was for £787.99 and they sent cheque for £218.55.

    How do i go about claiming the rest as in my initial letter before their offers i asked for the full amounts.

    has anyone got a letter i can use to claim the rest owed.

    I've just called the FOS press office who has said that yes the consumer has the right to ask for the money to be refunded how they want it.

    However, she also thought that the bank could come back and say no, and is checking where consumers stand when this happens.

  • Can anyone tell me if banks have to keep details of your account, i.e. be able to produce statements, for a certain amount of time by law?

    My husband recently requested details of 2 credit cards he held with Barclaycard to see if he had any changes he could claim back and they have written back to say that they cant trace his account. He provided them with full name, current and previous addresses, date of birth and date both accounts were opened and closed (although he doesnt have account numbers). Can they really wriggle out of it by saying they cant locate his account details?

    Write back and tell them you will report them to the Information Commissioner if they can't provide the information you require.

    Hiya, Well done on your refund its great to geta victoury isnt it? Can you let usknow how you get on with creation, l asked for charges and got statements back form a different card (delaytactics l expect) then l spent 2 days trying to contact them on the no. they gave me for their ..legal dept.but with no answer,so have had to ask again for charges,this has made me even more determined to claim and if they say sod off lm taking them straight to court. will keep you posted.
  • Just received a letter from the FOS saying I'm going to be getting a refund from Mint £240.82!! Hurrah! :D Now I just have to keep tackling Capital One, it's only £48 but I want it back, I think they may prove a bit more problematic!

    If you have been charged £12 for going over your account, can you claim this back?

    I have written to MINT using the templates. I have sent letter 1 and 2 so far and been fobbed off? They say there hasn't been any charges to my account over £12 so I will not be getting my money back =|

    Please advise my next step and will I be able to get this back?

  • Well most of my charges were pre- the switch from £30 to £12, and at first they tried to fob me off with the difference. Thing is, if you're going with the view that all charges are punitive, and therefore wrong (which I think is the general idea) then you should be wanting it all back. Therefore the letter you've had is more of less the same as I had initially, offering me the difference. The letter I received back from mint mentioned, 'this is a final response' or some similar sentence in it, do any of yours? That is the golden sentence which means your next step is to refer it to the financial ombudsman for them to investigate, martin has some templates for doing that on the site.
