    I have been charge alot on a credit card... But am having to pay back what i owe them via monthly payment due to threat of legal action.

    Can i still claim back the charges?

    I had a letter from the court saying the stay had been lifted. (eg With it being a credit card company).

    The form says The claimant should File AND serve a schedule setting out the dates and amount of each charge. Does this mean I just send one set of documents to the court (I was wondering what "file AND serve" means)
    The more I find out the less I know!
  • You "FILE" a set of documents with the court AND you "SERVE" a set of documents on the defendants solicitors. SO in your case you need to send 2 sets of documents. Hope it helps

    Very much so.

    Just off the phone with Virgin/Mbna! Had heard of the possibility that this was going to happen, so I contacted them 2 weeks ago to be told that my rate would not increase. Yesterday received a computer generated communication saying that they were upping the rate to 34.9%. You can imagine how ticked-off I am. Spoke to someone in the RDU Dept, who said that he would conference me in on a call with someone from the "rates" dept. Waited 15 minutes to be told there was nothing that they could do. I replied that I had actually been promised over a year ago that my rate would decrease. Also quoted my conversation of 2 weeks ago to them. I then informed them that I wished to make a formal complaint about the selective and punitive rate rises applied to my account.
    Was given the address & dept name of "The Customer Loyalty Dept!!!!"
    Needless to say it's off to the FOS & I am requesting a SAR from MBNA of all the data that they hold on me.
    Let's see how they react to that!!!!
  • i have two acounts whith mbna which i have started reclaiming back credit card charges, i am claiming back £1400 in total including interest.

    I have had a letter stating they have offered to repay me £360 in total.

    I do not want to accept this and want to carry on for the full amount, I wondered if anyone has got a template letter that i can send them to carry on my claim

    :mad: Hi All,l dont know if lm in the right place but has any one had any success in reclaiming charges on store cards, (creation financial services )in particular. l sent off the letter asking for the list of charges and they took ages only to send me the statments for another storecard, l think this must be a delaying tactic!!

    Yep my Adams card was thru creation - got full amount back without court or FO (but must admit it did take awhile) so keep going!

  • Well........the credit card reclaiming starts here. Having checked my credit report with experian. I have shamefully had 14 (2 are still used) credit cards (i'm only just 27 so thats in just over 8 years!) and knowing how i managed my finances when i was younger i knew there was no doubt going to be alot of late/over limit charges for me to get my mits on.

    So, i spent my Sunday morning ringing up all my past credit card companies hoping they would be able to give me my account numbers.

    1 x MBNA Virgin CC, 2 x MBNA A&L CC, 3 x Barclaycard, 1 x River Island Store Card, 1 x Beneficial Finance

    All gave me the ac!!!! numbers over the phone.

    1 x Lloyds TSB, 1 x Capital One, 1 x Halifax One, 1 x Mint - Couldn't give me the details as they couldn't find them on the system, even though some had been cancelled within the last year?!

    So....I have written to all the above using template 1 letter. So fingers crossed.

    Think i have used quiet alot of the different credit card companies at some point, so i will keep you all posted on my progress.

    I have already started the ball rolling on a A&L credit card. Sent Letter 1 on the 21/01/08 - Not 2 weeks later i had a reply with a detailed list of all charges to my account - Letter being sent tomorrow reclaiming £518.

    I'm hoping anything i claim from the above companies will be enough to pay my current credit cards off - if they all turn out to be £500 i'll be quids in.

  • Hi all, what a great thread this is.

    Has anyone had any experiences where Barclaycard have closed your account when you make a claim? I'm pretty sure there would be charges i could claim however i like having a credit facility for emergencys and don't really want to jeapordise it (it took a long time to get it):confused: .

    Also i had a bad account with Tesco CC that they closed but i did repay them in full all charges etc. I will persue that one first unless anyone tells me otherwise, now to find their details.

    P.S. A Huge thanks :T to those that reply so regularly on this forum, without you we would be non the wiser - On behalf of all NEWBIES.
