  • i have two claims in for two different companies, abbey and halifax. i use two different companies to deal with my complaints. the halifax claim for credit card charges, was sent and bank will pay back the amount requested, but the down side is, that they will only pay it back into the account it was taken from, and not direct to the complainant unless account has zero balance or account closed. i contacte dthe company who deals with my complaint and was told that is true. so i said why do i bother chasing up banks for the charges if it goes into the account it came from. all complaints where sent to the relevant banks addresses on statements. Banks win if they do not have to pay you directly.

    I am in the process of reclaiming my credit card charges. A couple of the cards have responded with small offers saying that they will pay it back onto my account.

    I have spoken to the National Debtline on this matter and they have said that as it is money that the credit cards owe me, I am entitled to ask for it in the form of a cheque. It is money that they owe you and what you choose to do with it is your business. There is NO LAW that says they can or cannot pay the money back onto your account (just in case they claim there is).

    The National Debtline advised me to write to the cards and ask for the money back in the form of a cheque. If I have any problems with any of the cards refusing to do this I should take my case to the Financial Ombudsman.

Word of warning, I payed MBNA a day late in January and they have whacked my APR interest up from 20.90% to 34.90%, and when I complained they told me that I have made 16 late payments. Well that might rebound on them!

  • I asked this last week but unfortunatelly in the wrong part of the forum...
    I currently have a nationwide CC and have 1 late charge for £20 which i am going to claim back possibly, I allso have about 8 x £12 charges which i didnt believe i could claim back untill i read this in the information pack on this site:

    "Charges after June 2006. For any charges on or after June 2006, you were probably hit for £12 each time. As this is already set to the OFT recommended amount, you simply need to ask for the full £12 amount to be refunded."


    Does this mean that i can claim all of the £12 charges i have had aswell after june 2006 ????????????????

    You can still claim for them, as no actual costs have been proven for these charges. The CC company will probably refuse, but if you follow the process, they should pay up eventually.
  • I have just undergone a painstakingly long process of getting charges + interest back from Capitol One, they initially offered £461, i refused and went thru the FO, & they agreed to pay up £1561!...............However, after waiting weeks for this I phoned them today & they have said they are using that to pay off the balance!! The account has been closed for years, i went thru a debt collection agency to pay it! Can they do this??!! I'm fuming

  • Thanks thats good enough for me, It seems a bit silly that they have set the charge to £12 as i still get hit with this every now and then, and presumably can get it back.

    Ive got nothing to loose I suppose as I have cleared the card now

    I have also received offers, stating that they will pay it off my account. I have spoken to the National Debtline about this matter (see post from 12 February). They told me there is no law to say that they can or cannot do this, it is money that they OWE YOU and it is not up to them to decide what is to be done with it. They have told me that if the credit cards persist with this, I should contact the Financial Ombudsman immediately and complain.

  • Hey all!

    I have just spoken to the FO and they have advised me that because reclaiming charges is a form of compensation we can request payment in any form that we see fit. So please don't be fobbed off when they say it will taken off of your debt!

    The FO also advised me that if the Card provider is refusing to issue and cheque and insists on adding it to your account or taking it off money you owe, to refer the matter to them and they will investigate!
