    Hi all,HELP..

    I rang my credit card over a complaint about a charge to be told by the staff that i had ppi and if i didn't want it,to claim it back.. I had no idea i had been paying for it for so long(8yrs).. Now i have to admit i don't remember the details of when i signed up for the card(even though i presume i must've signed something) but know i didn't want or need the ppi.. I rang the bank to complain to be told i'd be informed of the outcome, to receive a letter telling me i have no claim as everthing is correct and no sign of mis-selling.. My question is, If i didn't know or want the ppi is this classed as mis-selling and also, Should i take this further to the FOS?? Hope you can advise...

  • I have just successfully claimed my charges back from Natwest. Details below.

    I have an on-going one with Barclaycard. I have just sent them the court letter.

    Second week of February:
    Posted DPA letter (Royal Mail Recorded Delivery) – Requesting my default charges or all my statements going back 6 years. Cheque enclosed for £10

    A day later:
    Natwest signed for DPA letter

    Two weeks after that:
    Received a letter from Natwest dated 23rd February 2013. Enclosed a schedule of all the charges on my account and they returned my cheque as they do not charge for this service.

    I totalled my charges; it worked out to be over £350.

    Posted refund request (Royal Mail Recorded Delivery)
    This one does not show as delivered (Have no idea why)

    Couple of days ago:
    Received TWO letters from Natwest.
    First letter dated 7th March saying they are looking into my complaint and will update or respond in full within the next 10 days.
    Second letter also dated 7th March saying that they will refund me the amount requested PLUS interest.

    On the second letter it says:

    “Thank you for contacting us with your complaint relating to fees applied to your credit card account. I have detailed the findings of my investigations along with my proposed resolution outlined below for your information.

    I have investigated your queries and would like to advise we believe that our charges are fair, reasonable and transparent. Please note that any default fees properly accrued in the future will be applied to your account in line with our published tariffs and in accordance with your agreement with us, as detailed in your Terms and Conditions and on the reverse of your statements.

    Please find enclosed a schedule of refunds which relate to charges and accrued interest on those charges, made to your account over the last 6 years. Without prejudice, no admittance of error and as a gesture of goodwill, all refunds detailed on the schedule have been returned to you by the enclosed cheque.”


    Total refunded just under £480!

  • I have £20 late charges from 2005 (just 2) and 2006 (just 1) on my Lloyds TSB Gold Credit Card (it's certainly worth gold to the bank!!)

    Am I right in thinking that I cannot claim these back now because they are over 6 years old?

    I then have numerous £12 charges from 2006-2011. I cannot work out how I had accumulated so many during this period. Looking at my statements, I think I must have got the 'pay by' date wrong, as I was only a day or two out each time. I am pleased to say I am much more savvy now, thanks to this website... but can I reclaim the £12 or not?? I am a little confused about this - it almost needs a separate thread for post June 2006 charges!

  • Having meticulously gone through Credit Card statements and Terms and Conditions for Credit Card charges for a PPI claim I inadvertantly discovered that in 2004 and 2005 I was charged a figure well in excess of what is stated in my T and Cs for late payment fees and 'over-limit' fees. The card closed in late 2005 but I still have all the statements and a copy of the T and Cs. Am I too late to claim these overcharges back or does the six year rule apply here?

    I have read the article. It doesn't refer to my situation where there is a discrepancy between the Terms and Conditions and what is actually charged. The article seems to refer to 'unfair' charges which is different. The first is a breach of contract issue? The latter an issue of 'unfair charges' as outlined by the OFT?

    Yes, I have. It doesn't answer the question. It deals with the issue of unfairness, not of breach of contract?
