  • made a claim for misold ppi on my credit card and offered a refund but they have offset it on the outstanding balance iv never been in arrears and always made my payments on time and used the account within the conditions of the agreement can they do that
  • I have already sucessfully reclaimed £18,986 back on mis-sold PPI on my bank loan, but was wondering if I would be able to now try claiming against my credit card PPI.

Im only asking because I dont know if the resolution of the loan account draws a line under everything and therefore will not entertain any further claims. Or is the loan and credit card treated as two different areas and therefore I can now claim on the credit card?

  • Hi All,

This is my first post on the forum, so please forgive me if my question has been answered elsewhere.

I am about to send a letter before action to capital one for the sum of £192 (excluding interest.)

The credit card was taken out in 2009 and closed in 2011 but still I managed to rack up these charges regrettably.

What is the current stance with Capital One?

do they go right to court, or is it likely that they will settle within this 14 days?

    Edit: wrong thread.
  • Hi all,
Basically I have read the article but still not 100% sure.....

I have had about 4/5 credit cards over the last 12 or so many years.
Jumping from either better rate or balance transfers,

How do I start to find out weather i can claim etc...

    Thanks.
  • Quite a lot of recent posts ask for help and guidance to reclaim cc charges. This should help from the MSE main site.

If your reason for incurring charges was due to financial difficulties then just send a letter telling them this and will they consider refunding the charges as it would help you etc.etc. Also, if this was the case, had you notified them of any difficulties at the time as this would help your case?

Court action should only ever be considered for bomb proof cases and in any case not for £192 as it would prob. cost you a lot more should you lose. If the bank had made an error or had been/or is being unfair then you should consider going to the FOS first which is a free service. You need to have a good reason (not just because you are miffed you overspent) on which to base your claim.

If the charges were because of account 'abuse' then forget it.

Don't start your communications declaring war and threatening court or you may find they will simply dig their heels in.

Hi, I wrote a letter to HSBC last week about them charging on top of charges and because of financial hardship. I received a letter to me saying that they're going to do nothing about it, and are referring me to the Ombudsman. To myself this looks like one of the standard letters as a way to scare you off or put you to a stop.

Is it best to now go to the Ombudsman or to send another letter to HSBC?
