Can someone please help me understand why the article on claiming cc charges back says you can claim for the full charge, even if your lender has only charged you the £12 which the OFT consider acceptable.

The OFT do not consider £12 charges as acceptable, but rather any charges in excess of £12 to be automatically unfair.
That is a subtle, but at the same time very distinct, difference.

Some posters get their charges back no matter what value they were.
e.g. here we see evidence of a poster claiming to have been refunded £8 charges

    I know that poster well!!!

FOS have rejected my complaint for a refund of all charges, they were all £12 from MBNA. I can't complain as the charges are all my fault, but unread other success stories of reclaiming £12 charges and admit to being slightly envious!
  • Hello. Just joined forum and need advice. Single dad following bereavement and struggling. Back in June 2007 I managed to settle and pay off two Barclaycard debts amounting to £13005.00 and immediately closed the accounts. Prior to this I had struggled and incurred high late payment charges and penalties. Am I able to retrospectively make a claim for these charges, and for what period of time am I able to go back. Is there a cut off threshold? Any advice will be greatly appreciated.

Has anyone had any success in reclaiming charges from Aqua? I Senta letter reclaiming and have had a flat no from them.
  • HI all,

I just wonderd if anybody has experience to get Credit Card charges back from Opus credit card. I had success to re-claim the charges from RBS however just received a letter from OPUS that they won't be refunding the charges as they are not unfair and only cover the cost.

Had anybody success at re-claiming charges back from OPUS?
    Thanks,
    P.
  • is there anywhere on here which discusses how to approach a court case in small claims court? i have been given a date for a hearing for credit card charges and need to know what to say. i know small claims court is informal but obviously i will need to argue my case.
