  • Is it really aseasy as it sems on this forum - I don't have a lot of confidence dealing with banks - should I use one of the firms advertising on the TV all the time?
  • Hi

Can I ask a really fast question.

I wrote to MBNA and asked for my charges back as instructed on this site. Received a letter back this morning telling me to go away, which I did expect.

When I have looked the next letter along is the Court Action on.

Should I send this next or do a letter saying I am going to the Financial Ombudsman or do you say both in the next letter.

    Thanks for any help

I had similar situation with MBNA. In my case I did send the Court Action letter but I amended it to my case and asked them to reconsider ( even though they said it was their final word on the matter) and reminded them again why they should refund me. In two of the cases I was refunded in full plus interest after sending this letter and the 3rd MBNA card I have is currently awaiting a response. They have written back to confirm that they are reconsidering though. I strongly suggest you give it a go. Just because you tell them you will take it to Court doesnt mean that you have to. If they still come back and say no you can then go to the Ombudsmen, prior to going down the court route. You really have nothing to lose.

    Good Luck !

Thank you so much will give it a go. It all seems a little frightening when you mention court action in a letter.

    Hi

look at my post from a few days back, i wrote to the FOS with regard to MBNA charges - all £12 charges.

I got everything back, plus interest! - they gave in when the FOS contacted them, they did not want a full FOS investigation!

Thank you to both of you. I have done a letter and am going to post it when I go to collect my son from school. I dont think I would have sent another letter but thanks to your comments you have really encouraged me to do so.

    Take care

No I really wouldnt go down that route. Theres no guarantee obviously that anyone will get their charges refunded, but its worth a little bit of time and effort. Its not difficult, just follow the advice on here and use the template letters. I find if you can personalise them slightly that does help. You may not be confident dealing with these people, but all dealings are generally in writing so you wont need to enter into any conversation with them. Give it a try, they can only say no !

  • hello everyone, not sure if this is in the correct thread, first time poster so excuse my ignorance !!

I had a loan with the Halifax a few years ago, rung and asked if I had paid PPI on it but they said I hadn't, fair enough. However, the chap I spoke to then said that I actually had PPI on a card for a number of years, this surprised me as I only got my first credit card last year. He gave me a reference number and put me through to their PPI dept. I quoted the reference number and the lady asked if I would like to put in a complaint so naturally I said yes, and she said the forms would be sent on to me. I'm now a bit worried as I have no idea what to fill in as i've no idea what i've actually had PPI on, if indeed anything. But i thought if there was nothing to claim, they would have said there and then.

Thanks in advance for any help from you guys and gals
  • Hi, just wondering if anyone knows if it's possible to place a claim if the debt was only part repaid but accepted as settlement. A couple of years ago my parents credit cards and loans caught up with them after lloyds encouraged them to take out another loan in order to close their lloyds credit card. The repayments were 500 per month and needless to say this was the point at which they were unable to meet their financial commitments. They sold their house and used the little cash they had from the sale to part pay off the loans and credit cards providing the accounts would be closed. If we now try and make a ppi claim will they be able to chase my parents for the remaining debt?
