Hi, just wondering if anyone knows if it's possible to place a claim if the debt was only part repaid but accepted as settlement. A couple of years ago my parents credit cards and loans caught up with them after lloyds encouraged them to take out another loan in order to close their lloyds credit card. The repayments were 500 per month and needless to say this was the point at which they were unable to meet their financial commitments. They sold their house and used the little cash they had from the sale to part pay off the loans and credit cards providing the accounts would be closed. If we now try and make a ppi claim will they be able to chase my parents for the remaining debt?
You can't expect a company to refund an amount that was never originally paid.

I have been reading these threads to find inspiration and courage to tackle the credit card companies.
I have paid off 2 credit cards in the last 6/7years. I have one account number for my Barclaycard but no account number for Capital One and not one shred of paperwork. Can I clarify that to get the ball rolling I first have to write to the companies giving them as much info as possible, (addresses, maiden name, rough dates) but what do I ask for? Do I just ask outright in my initial enquiry if I paid PPI or do I leave that for the follow up letter?
I am struggling already and am seriously daunted by the task in front of me.

would like to claim ppi and charges on three store cards but finding it hard to get addresses to write to as I have no paperwork whatsoever but I do still have the cards with numbers on them.
Need help to find contact addresses of Principal store card, debenham card and dorothy perkins. I live in Belfast and no longer use the cards but did up to three years ago but I am sure that there was ppi etc on them
And also what is the first step I should take. Any help is appreciated:)0 -

Hi I sent Barclaycard (credit card unused and account closed for a good 4/5 years) a letter asking for a copy of the T&Cs and they sent this reply
"As no sum is, or will or may become payable under your credit agreement, Section 78(30(a) of the Act provides that we are not obliged to provide you with the documents and information you seek."
Can someone help me with this? Is this simply the first smokescreen - in which case, what should I do next? Or should I take t at face value and no longer pursue it?
Due to many house moves and many children, I have no records to refer to on the account.

I have followed the advice on reclaiming my PPI on my credit card. I have been sent a letter stating the following:
Total amount of PPI premiums since date of account: £743.93
Total amount of associated interest associated: £697.82 Applicable 8% interest: £42.98
Total amount payable to me: £3.13
Could someone explain this to me. I really don't understand the figures or the interest and why the amount being paid back to me is so little.
Can anyone help?

Well after the success of being paid from MBNA I have now moved on to Capital One.
Sent them a letter with the list of charges some £20 and some £12. The total all together including interest was £196. Received a letter on Friday to tell me to go away. So this morning I have completed the FOS form and I am going to post it later today.
This worked with MBNA so lets hope it works again.
I requested £69 back from MBNA when the cheque arrived they had paid me £102.60. Does aybody know why this happened or is it because they pay a higher amount of interest than I added?

Hi I'm new here, but have been viewing the site for some time, but now I need some assistance please!
Can anybody advise me on what my next actions/options are regarding claiming back credit card charges from Lloyds TSB, Halifax, Capital One and House of Fraser?
I started the process back in March/April last year using the Stage One template letters and got the standard response that the £12 charges were fair and they quoted the OFT "would take no further action where charges were set at £12 or below". Lloyds have offered me a token refund of £76.92 (I'm claiming £761.65). However this refund was first offered back in March last year and they said I had 6 months to contact the FOS if not happy and the letter can be taken as a final reply. That was the end of April last year (some 12 months ago), so what's my position now? I have the same situation with Halifax and Capital One.
Can I now go to stage two i.e. letter before court action, as my complaint has not changed, it's just 12 months later?
Any advice would be gratefully received!0
