I think if the cheque is offered as "full and final settlement" you cannot cash it and continue your fight. They want you to take the money and go away.

Apologies if I have written in the wrong place Myself and my husband are trying to reclaim credit card charges from MBNA and Lloyds TSB. We are at the stage of court action and this has been logged with the court TSB have decided to defend and we have a questionaire to complete. MBNA did offer a very small amount and we sent this cheque back to them and said that we will continue to court which is what we have done, they have said that they will defend their case but have sent a cheque which they have said is a full a final settlement of the complaint. The amount they have sent is a long way from what we feel we are entitled to. They have told the court that they have sent a cheque as a goodwill gesture. Question do we cash the cheque reply to them and the court saying that we will accept as a part payment and continue with court action. or do we return the cheque to them. Have many gone all the way through the court system.

I treid to claim back just the £12 charges from MBNA total over £660 plus £130 in interest.
I went through all the letters on this site, and got nowhere with MBNA, they refused to pay anything.
so i thought that was it - last month a wrote to the FOS on the of chance they might look at this for me (i know they say they do not look at the £12 charges).
any got a letter in the post this morning from the FOS, saything that MBNA have agreed to a full refund, plus interest!!!!!!!!!!
Just goes to show, you have to try everything with them - DO NOT GIVE UP PEOPLE!:T0 -
have tried to reclaim charges with abbey and got to the court stage and have been awarded a judgement by default for approx £1000.
I decided to close my account and wrote to abbey with the court judgement and paid the balance minus the court settlement. Abbey have not reduced me balance and have sent me a statement with the £1000 outstanding and more interest/charges etc.
what are my options now ? FOS or balliffs0 -
Abbey have written to me saying they will reimburse the £1000 chagres and take it from my account

As it's now March 2012, and the OFT (?) has rules that £12 is a fiar charge, if my credit cards have only charged me £12 for each late payments e.t.c. can I claim that back? Or do i have to accept the charges?0

Read up on advice for reclaiming on this site.
Write to your bank with as much detail as possible including all addresses used whilst accounts were in operation. They should then be able to trace your details.0 -
