    I would think that because it's well over the 6 months period, not only can you NOT go to the FOS but the banks will have closed their files on your claims too. You will need to do new claims.

    Given the Lloyds offer was much less than you claimed, use the experience you have gained from your first claim to make your next one stronger!

    Thanks for the response Little Mo 70, I just received a letter this morning from Lloyds regarding one of the credit cards I had with them, they state they had provided me with their final response (and attached a copy of a letter sent back in April 2011) and say I can ask the FOS to look into what happened. They also state they have closed their file, but will co-operate with the FOS if I decide to ask them to look into my complaint.

    What I would like clarification on are the following points if at all possible:

    1. Can I still go the route of the FOS even 12 months after their final response letter?

    2. I have in effect started a new claim as I issued new Stage 1 letters with updated interest clacs, followed by Stage 2 letter 14 days after Stage 1 letters. Do I now issue court papers as per the chain, even though they have stated the files are closed?

    3. They state that although my account is closed, I have an outstanding balance with their Consumer Debt Recovery Dept, therefore they will use the original offer (£90.28) to reduce the amount owed. When the account was closed, I reached an final settlement agreement with them, therefore I am unaware of any outstanding balance still remaining!

    Any advice as to what my option are or suggested next actions would be very much appreciated.

    Tricky one this. I would phone FOS to ask advice. Tell them although it's over 12 months ago since you received your final response Lloyds have agreed to co-operate fully with FOS should you decide to use them.

    Regarding court action? In view of the fact you are informed you owe them money, this could go against you. as it may be deemed you have not paid or attempted to repay your debt. Do you have in writing, the final settlement agreement? Statements or anything? If not, you may lose. Not having dealt with any court action however, I am only expressing an opinion you understand.

    You could always write back informing them that you settled or perhaps check out your credit rating and see what's on there.

    So my answers would be:

    1) Phone the FOS and see if you can send your original complaint for their review but mention that the amount of your claim is now more because of the extra interest.

    2) Court may cost you and you could lose. Use FOS first.

    3) Check out the alleged amount owing. Check out your data protection info.received at time of orig.refund request or check what paperwork you may already have had on this. Be aware this could go for you with FOS and against you with court.

I've not bothered before as the accounts have been paid and closed so I didn't think it was possible to reclaim anything. Now I'm wondering if it's too late? Can I only claim any excess charges incurred in 2006? (now that we're six years on). Or if the account was still active in 2006 can I claim further back?

    Any help greatly appreciated, thank you

  • Not wishing to go over old ground but I could do with a bit of help. I have a live account with Next and it appears I have been paying PPI since I opened the account. I dropped a letter to Next asking them to look into my request, as to be expected the standard reply with a note saying they were not regulated by the FSA, can this be the case and if so who is regulating them.

    Rather than getting into a letter writing debate would i be best placed just to go direct to the FSA regardless?

    Hi all,

    I received a list of charges from my CC company dating back to 2001 -2008. Using the MSE calculator I worked out the amount I felt was due and requested the charges (most were over £12) using the template letter.

    The CC has responded to my claim and rejected it due to the fact that most of the fees are over 6 years ago and those from 2006 onwards are fair in their opinion.

    From past experience, has there been any success from claiming more than 6 years back?

    Can anyone please tell me whether it is possible to reclaim mbna accident insurance charges between august 2005 and october 2007 at £10.95 per month. I was and still am self employed if this has any relevance.

    CASH INTEREST £72.01
    LATE FEE £96.00
    OVERLIMIT DEF £120.00
    PURCHASE INTEREST £54.13

    Could someone please clarify what charges I should be claiming back.
