Credit Card Reclaiming Discussion

  • Hi

I'm a newbie, apologies if this is covered already somewhere.

I was one day late on payment for my AA credit card currently on interest free. I was charged £12 plus interest of £67.01. They explained I had broken the terms of interest free.

They offered to refund the fee and half of the interest but break interest free, or I pay the fee and interest and they would reinstate interest free. I agreed to the later.

Is this fair? Could I still claim the interest charged as hidden fees?

    Thanks for any help

  • Hi all

A few years back I 'successfully' accepted an offer from Capital One as a 'gesture of goodwill'. It was alot less than the amount I had claimed for, but it was also around the same week that the court case put claims on hold. I didn't know at the time that the freeze didn't apply to credit cards and in my ignorance accepted the amount offered just in case the ruling went in the wrong direction.

Since then my financial and credit situation has improved, and ironically I now work in the financial industry. Although my credit has improved dramatically, I still have a default from Capital One which doesn't expire until May 2012. Other than that I have a great history on my other cards/accounts so it's a real shame that my rating is blighted my brush with unfair charges.

Can anyone tell me if I have any recourse to have this default removed?

    Appreciate your responses on this.
  • I had a cpaital credit card which i closed two years back. My query is should i go for claim and if yes, what is the procedure, i am an newbee to this situation. Your help is sincerely appreciated.

Only you can decide whether to claim or not, ie: do you have a valid reason to request refund of charges? Did you abuse your account or did you manage it carefully but events overtook you and you got into financial difficulties, or do you feel that high charges led to difficulties of some kind, that sort of thing. Your claim has to have some sort of reasonable basis. YOu can't just ask for your money back without a good reason and even then there are no guarantees.

When I was a newbie I studied the advice on this site first which helped me decide I had valid reasons to claim. It can be a long process. All the help you need for making your claim is listed in great detail on MSE site. You just need determinatiion and patience.

    Good luck

    Hi
Look up the PPI information/advice on MSE site and go for it. Had you not noticed before that you were paying PPI? 6/8 years just seems a long time to not know.

If anybody can help please :(
I have been self employed for a number of years and I got myself a Barclaycard Visa that I defaulted on a couple of years back due to no work around at the time. I got myself an arrangement plan with them and am paying back the money owed. I have just found the original PPI document that they sent me when it started but they said it didn't kick in as I was only out of work and not bankrupt or in administration  I'm new to this so all help would be appreciated :)
  • Is it literally the last 6 years you can claim back CC charges. I went through a bad patch getting on to 10 years ago, but got hammered with charges. is there anything i can do ?

Within 6 years they are not obliged to refund your charges. Outside 6 years they will prob.tell you you're out of time "Statute Barred".
Either way they don't have to refund anything.

If you feel their charges contributed to your financial difficulties you can try claiming because of hardship but I believe you need to show you are also financially suffering now as well as then. Put a really strong case together, be prepared to prove it and see what happens.

Only you know how badly their charges affected your account/life

If the T's and C's state payment made on Bankruptcy/Administration only there's not much you can do. You could always see if claiming refund of charges through financial hardship might apply to you. Check out on MSE site first.
