Any charges refunded will automatically be taken from any balance you have outstanding on the card first. It's up to you whether you think it's worth it or not - surely getting money back often from simply putting in the effort to write a few letters is worth it?

    Claim £466.56

    Payment Due: £466.56

    Hi all

Got the letter in the post this morning, full payment back of £466.56!!!!

This is all for £12 charges dating back no further than 2008!

Its only taken 2 letters to them. The 1st letter from them was the basic sod off - our charges are fair letter, so i sent them the 2nd letter and told them i would take court action, and they pay up!

Thanks you all so much!, i will now go full throttle and claim the rest back from the others (Egg watch out!)

I would just like to re-point out that this was a claim for just £12 charges, so just goes to show that they will still pay out!

They try to puch you in to the FOS system, knowing full well the the FOS will not investigate the £12 charges. If you are just claiming these, tell them you will goto court and take them if the still say no!

    Well done!!!!:beer::rotfl::beer:

I know it sounds silly asking if it's worth trying to claim back money I may have been falsely charged for but I want to know what the likelihood is that I will come out with something before going down this route

I would like to know if anyone else has tried this method for reclaiming by requesting that any owed charges be simply removed from the outstanding balance of their credit cards and if the banks are more likely to agree to this proposal rather than refund me any owed charges

Any thoughts or advice would be very much appreciated

Apologies if I have posted in the wrong thread or if someone has already asked this question as this is my first post on any forum... Ever!

    Thanking you all

    DanBar,

    From my experience, this works!
One credit card provider paid the money I claimed back straight off my balance.

    Hi all

Sorry to probably be asking this for the hundreth time but have never looked into this before and am a bit unsure what it is possible to claim for.

I have only ever banked with Natwest, had 1 loan with them which i increased a couple of times and 2 credit cards with them but am now down to just the 1. I used both credit cards regularly and paid them off bit by bit each month by standing order and sometimes made an extra payment to pay them off, i currently have about £300 left on my last card. What exactly would i be able to claim in this situation? i never had PPI on my loan or cards as requested it to be taken off so hope they did so, am i able to claim back my monthly charges for having debt on the card?

Thanks in advance for any clarification here.

    Cheers
    Matt

    Hi,
I am looking for advice please, I had a period of financial hardship 2007 - 2009 and had a repayment plan (interest wasn't frozen but reduced, they were set for 6 months at a time, however when I came off plan automatically after 6 months and obviously couldn't pay minimum payment I got charged £12 each time until the agreement was up and running again (they played hardball, kept on telling me I could only have agreement for a limited time, anyway i'm off it now and trying to pay minimum payment)
Anyway I didn't find them very helpful at that time and want to claim back some of the money which I feel they stole from me, when I was struggling!!
I must have paid hundreds to them in charges.
How far can you claim back for cc charges, I opened TSB account in 1996, when charges were £25.00! I know for everything else it is 6 years, is this the same?
Am I best to use a company or try to do it myself?
I don't know whether I am pushing my luck as I am in process of trying to claim back PPI!
Any advice would be greatly appreciated.

    Thanks

Definately don't use a company, there is a very straightforward step-by-step guide on here so why pay out your money to someone else? 6 years worth is what the banks will try and tell you and you can generally get this back fairly easily. Further back can be reclaimed but be prepared for them to dig their heels in and you may have to go all the way to court.
  • just a bit of a heads up, i have recently beaten both capital one, and barclaycard over all of the charges i received, mostly £12 ones as well, thanks to the help of this wonderfull site.

my last complaint was against lloyds tsb, i claimed back nearly £700 charges, but most of them were £12 charges, on the basis that i thought they were unproportionate, and that i was actualy charged £24 most months, once for missing payment, and once for going overlimit.

this was actualy a period in my life when i was redundant, and unable to find work.

anyway, lloyds tsb challenged me, and said theyre charges were fair, so after a few more letter without joy, i took it to the f.o.s, who carried out an investigation.

LLOYDS TSB dragged this out, and i had a letter, last week from the F.O.S., saying it had now told them to either pay back the charges, or provide evidence that its costs are £12.

WELL, i have just had a letter from the fos this morning, saying that having reviewed the evidence lloyds tsb have sent them, at the last minute by the way, that they agree that the charges are in proportion to the costs.

although, i am still quite happy with winning 2 out of 3, as lets be honest, i knew what the consequences when i took the cards on. i still cant help but wonder, what the evidence was that they presented to the fos? do i have a right to access this?

also, i could anyone advise me, is this now the point where i should say, ok, leave that one. would i be wasting my time filing a claim through mcol?

i worry that lloyds tsb would now win in court, saying the fos agree that £12 charges are fair?

Interesting case. I would go to court. They wrote me a letter today saying that as most of their services are free, the feel that they have a right to charge default sums. WHAT?!! FREE? WHATS THE 30% INTREST FOR THEN?!!
  • yeah thats rubbish, free? haha. as i said, i wasnt realy that bothered about not beating them, but then i remembered how bad they treated me , when i was unemployed.
they just kept on charging me, for both being overlimit, and missing payments. it is for this reason i might take a gamble , and lodge a claim through mcol.
i am actualy thinking of emailing the ceo of lloyds personally, and trying that route.

still though, does anyone know if i have a legal right, to see the evidence they have given to fos, proving theyre £12 fees are proportionate?
  • Hi
I need some help with credit card charges reclaiming.
I read Martin's article about that dating to 2009, sent off data request letter to Vanquis credit card (I have changed address since the time when I 1st got a credit card from them)
and now not only they are requesting 'original' document as proof of new address OR 'certified' copy which obviously costs money and has to be done through law firm, as far as I know, but they are also stating that according to FSA guidelines they have 56days to resolve a complaint?
Just wanted to check if anyone knows whether that is indeed the case, as I was under impression it is the same as for current bank accounts, which is 40 days? since it is not actually a complaint but a date request?
Many thanks for any replies :-)
