    After totalling up all my Natwest Mastercard charges I sent my first letter to Natwest, the letter was based on the template in the credit card reclaiming article. The charges were £12 each on 24 occasions, adding up to £288.

    I recently received a letter back stating that the default charges were in line with office of fair trading guidelines and therefore no refund would be offered.

    They also go on to say that I have the right to contact the financial ombudsman service if I am not happy with the response, but that they hope this will not be necessary.

    I just wanted to determine what my next steps should be.

    Any advice would be greatly appreciated.

    i am just in the process of writing to my credit card providers the guide is very useful so thanks for that

    quick question

    one of the companies i have sent the first letter to have cashed the cheque but i havent received any response from them yet? (cheque cashed ten or so days ago) whats my next step here?

    just had my first rejection letter as well but the guide has helped me with the next letter

    If by first letter you mean your SAR they have 40 days to comply with it.

    actually got some gumph through from halifax (they had cashed the cheque)saying they are processing my request!

    Sorry if this being asked few times, i fully appreciate if someone can give some guidance.

    I could not find my Credit Agreement, looking from the main PPI claim page, It said £1 to get the documents, however, i am confuese with another one which £10 for information.

    My question is which one should i go to? (£1 fees or £10 fees).
    I found the template but not sure what HSBC address to write to for retriving the Credit Agreement. Also what should i write on the cheque for HSBC? Their Branch name, address, department, Etc.)

    Sorry for these stupid questions because this is my first time to write a cheque. I did not use cheque at all and thanks if someone can give me some guidance here. Thanks in Advance.

    Basically you can write to them and just ask for your credit agreement and there is a £1 fee for this. If you need other information - for example statements, copies of letters, manual interference on the account then you need to send them a Subject Access Request asking for all the information they hold on you.
    Regarding addresses I think there were some links on the site but I would generally go on the company website and send to either Customer Service or sometimes they will have a Data Specialist department. I wouldn't worry too much, they're used to things being sent to the wrong departments and it all gets passed round internally anyway :)

    Hi all

    Wondered if you could give me a little help with this one I have tried to reclaim the PPI on my Freemans accountand was unable to so I have tried to reclaim the charges on the account, last year I requested a SAR and sent off a £10 cheque (which was cashed) but I didn't get any statements or anything !!! I have since paid the account off and Requested this information again and this is the reply I got. :-

    I refer to your recent letter which has been passed for my attention.

    I have given further consideration to the matters you raise, but I can only reiterate my conclusions as outlined in our letter dated the 10th Feb 2010,(I didn't get this )

    I would point out that under Consumer Credit legislation we are justified in applying a charge wher defult of our payment terms has ocurred. The OFT considered the question of default charges in realtion to store cards It is questionable whether their findings apply to other forms of credit, Including mail order. The OFT did Not state that these charges were unlawful, but that in general terms, should not exceed £12 per charge. As above, it is questionable as to whether this funding applies to mail order.

    I have interrogated our systems and note one default charge of £12 on the 2nd December 2008. As this charge does not exceed the OFT recommended £12m thershold, no refund will be payable. This is therefore my Final response on the matter.

    What do I do now ?? is this right I know that before 2008 I did have a few charges on this account the £20.00 you know that you get !!!I have had this account since 1997 do I go to the FO ???

    had my first good letter for a while today opus refunded £243.16 straight to my opus card (i only claimed 60 odds pounds worth of charges!)

    how did they arrive at this figure? not that im complaining at all

  • Hi..MSE newbie here

    I just received a letter from the Halifax admitting that they had incorrectly calculated interest on a credit card I used to have (the account has been closed for a few months). They are offering me £2.50 (haha!) but I'm wondering if I can go back to them with a valid claim for more reasonable compensation given that its a pretty serious failing in their process and that they've admitted they made a mistake.

    Anyone have any thoughts or experiences they could share on this?

    I am in the process of claim back my charges from Egg, these are all for the £16 charges that they issue.

    I have had the first letter back from them, telling me to do one! lol

    They also state the the £16 charge is fair and agreed with the FOS, what should my next move be?

    I have sent a 2nd letter telling them i will take them to court, is this what i should do or is it still worth going to the FOS?

    As anyone else been able to claim back just the £16 charges?
