    My wife has been charged £12 for a late payment (2 days).

    This is the first and only time it's happened.

    She wrang HSBC, and they are refusing to pay the £12 back, she asked to close the account, and they said fine!

    Basically as a customer of HSBC for 20 years, they seem fine just to cast her adrift.

    So, should we persue them for the £12? Will it really have any affect on her Credit Rating (and mine!).

    She's now too upset to talk to them again and would like me to do it, but I have a feeling that they won't talk to me.

    It could be a long battle over £12, it depends on how stubborn card company want to be. If defended, then you won't get £12 back as it obviously costs something because your wife defaulted.
    Only fees over £12 are automatically considered unfair by the OFT, and who would probably pursue the company themselves if that were the case.

    Persuing the matter will not affect your wife's (or your) credit rating, but you may not get your court fees back which will be more than £12 just for filing.

    The company will not speak to you unless your wife gives them express permission to speak to you over the matter.

    Your wife is clearly upset by the whole event, and that being the case I wouldn't advise prolonging the issue over £12 or less. The company clearly have shown no goodwill to her. She should just vote with her feet.

    Actually I did get to speak to them not long after posting the message.

    After making my point, strongly but firmly, they agreed to give her the £12 back.

    A small victory for us all!

    Just a heads up really and a bit of advice if poss please?

    Capital one i wrote to them 2 times last year and never had a response so i have just done a letter using the template its only for £122 but fingers crossed i may hear something this time. This is for late payments and fee's . My credit limit has only ever been £200 and had this card since about 2004 so £122 is minimal compared to some but still unfair.

    any further advice or should i just continue as i am and follow rules and guidelines on here

  • I had an Egg card which defaulted and the account was then sold on to Lowell, which I have since settled. I'm trying to reclaim the default charges from Egg but I got a letter from Lowell to say the account was settled. So I phoned Egg who said that as the account had been sold on they don't have any details of the charges.

    Are they just trying to avoid paying me back? Are they really that rubbish at holding onto information? Would Lowell have the info? Should I take it to the Information Commisioner?

    Yes they are just trying to get out of it :) Did you send them an offfical Subject Access Request or did you just ask them for details of the charges? If it's the former then they have a legal obligation to respond within the timeframe and if they don't then yes you can take it to the ICO.

    I have written to Lloyds to re claim on previous loans, credit card and bank charges. The only letter i have had back is one to say they cannot investigate as i wasn't paying ppi !! I have found a statement which proves i was, just wondering if this is a general Lloyds tactic?? this card has been on the go since 1984... does anyone know the chances of reclaiming that far back?...thanks

    The bank are probably as confused as I am. What is it you are actually trying to reclaim? If it's PPI payments, I suggest you try here

    Hi All,

    Pretty new to this but was successful in claiming all my charges for my credit card over the last 6 years at the end of last year totalling £1,500.00 so looking in to getting my PPI back also! Allbeit a long winded journey...namely numerous letters to MBNA to get charges back, accepting their offer of £700ish but then going via the Ombusman for the rest and succeeding!

    Anywho was looking to get on the PPI band wagon and any help would be gratefully appreciated. I dont have any paperwork for when I applied for the credit card but am almost 100% certain that it was done by completing one of the pre-ticked box forms (I took my CC out in 2005).

    My total PPI payments, plus interest should total around £1,200.00. I wrote asking for T&C's but this does not really tell me what I applied for nor the PPI element. I then wrote back asking for a copy of the application twice - NO RESPONSE.

    Has anyone ever actually got a copy of their application form back? If so please let me know! Am considering a letter explaining why I feel i've been mis-sold and asking for the amount back with a calculation to back up...any ideas?

    Re MBNA - yes I had success with MBNA last year - although was very long winded! Took a while and had to go the Ombudsman route but they ruled in my favour! If they have refereed you to the Ombudsman go to them - chances are they will also rule in your favour. I won nearly £1,500.00 back.
