Credit Card Reclaiming Discussion

You appear to be insisting in asking for duplicate statements. They do indeed cost £3 I believe.
What you should do is a SAR and you get that from their DPA team, hence why they gave you the address.
The MSE guide explains further
I have just begun the merrydance which Barclaycard led you.
I'm hopeful my Subject access request, to the address above, will be more successful. I shall keep you informed0 -
Claiming back charges from Citicards but they have rejected my claim. More than 6 months passed since rejection, so I can't go to FOS
I have heard they will strongly fight court claims
I'm not afraid of a small claims court but wonder if anyone else has had success (or defeat) vs Citicards in court?0 -
MBNA playing hardball
Has anyone had any success claiming back late payment and interesst charges on their MBNA credit card? I sent my claim for £336 a month ago and MBNA sent me one letter saying they disagree with the Ombudsman findings, they consider their charges to be fair and transparent and rejected my claim on that basis. They will not enter into any further discussion unless instructed to do so by the Financial Ombudsman Service. Bit hard core me thinks but has any one any suggestions on how to crack this one?
It depends whether you are wanting to go down the FOS or the court route for it. If you are looking at the FOS route and MBNA have clearly stated on their letter that this is their final response then you can take it FOS now. If you're looking to go down the court route (which I did) then your next step would be to send them a Letter Before Action - I got a similar response to yours from Cap1 so I quoted back to them from the OFT:
“We consider that a contract term is likely to be unfair if it requires consumers to pay more as a result of a default than the court would order them to pay if they were sued for breach of contract. This means that a default charge should not exceed a reasonable pre-estimate of the administrative costs that the consumer ought to have realised would be likely to be incurred by his or her card issuer in dealing with defaults”
Therefore if you consider your charges to be 'transparent and fair' then you must demonstrate to me that it costs MBNA this amount for late payments. I should warn you that in any court claim I will ask for strict proof of this charging structure.

hi, i know i have had charges of the £12 variety on credit cards in the past but, i have closed them and moved the balances etc, and i wouldn't know which ones incurred charges...... if i was to get a copy of my credit report it would have all my closed credit card accounts on (to a certain point) but would it say if there had been any late payments on them? I know its not going to amount to thousands maybe not hundreds but if theres a chance i might be able to get them back i would like to try. If anyone has any other method to finding out which cards may have had charges against them i'd be keen to know, cheers0

Your credit report wouldn't say if there were charges on the cards - if you had defaults on any of them I would say it's a pretty safe bet there were charges as well but could still have charges and no default. As far as I know the only sure way would be to get the statements from the credit card company.0

Does anyone know if this mysterious "Subject Access Request" will detail any charges?0
-
What's mysterious about it?
Basically you are asking them for all information they hold on you and your account so that will include transactions and any charges on the account. They don't have to send it in official statement form but it does needs to be understandable. They have to supply this information under the Data Protection Act so can't get away with saying they don't do copy statements or trying to charge you for each one. There should be a letter template on the site if you need one and include a £10 cheque - they then have 40 days to comply.

Hi, my query is credit card related, although not related to late payment charges, etc. but I can’t seem to find advice anywhere else.
Has anyone else experienced the situation where your statement shows a particular interest rate, but the card company are applying a different, higher rate?
I have a Lloyds TSB credit card, and this has been happening to me – apparently for a substantial period of time (at least four years that I know of and possibly more) they have been applying a rate 1.5% higher than the one shown on my statements.
I have spoken to Lloyds TSB (who disputed the lower interest rate I stated) and have sent them copies of statements, letters, etc along with a very strong letter. I have requested a complete breakdown of interest rates they’ve applied, dates they were applied, etc so I can gauge the scale of the problem.
My assumption is that I should have been paying the interest rate that was detailed on my statement and, as they have charged a higher rate without telling me, I should be entitled to a refund of the difference. I also feel I should be entitled to compensation, as I have lost interest on the overpaid money.
As this has been happening over a long period, it seems it could be very complicated to ascertain what I am owed, and I wanted some advice on what I can expect from the credit card company – are they compelled to refund this difference in interest and provide compensation?
I would be grateful for any advice0 -
I have just had a phone call form a company call consortium reclaim claiming they can get my £2400 credit card bill written off provided it was taken out before 2007 (which it was), they then after quite a bit of jabber went on to say that they charge £495 for this priviledge and that they can add this to my credit card which I then won't have to pay in essence because they will get my debt written off along with the their fee that I pay them with! I put the phone down on them as I was suspicious, I didn't want to part with my credit card info, even though they said they were regulated with the ministry of justice and took me to their site on the web over the phone - so what I want to know is:
Can I really get that debt written off? I pay over and above the minimum amount because I have a repayment cover on their which amounts to around £20 per month, which is something that has always chewed at me to be honest!
Please can someone give me some advice in layman's terms over what would be my best course of action.
Many thanks
Cathy :j0
