Hi all just started a claim with egg. Over £200 in £16 charges dating from the last 14 months.
They responded to my first letter defending charges purely on the oft 2006 review saying they are for reasonable expenses etc and they had been exempt from the £12 limit.
Now I presume this means I probably couldnt go to the ombudsman but can take them to court as the the charges do seem unfair and disproportionate?. Now I gather that cards tend not to defend as they would have to prove what the charges are made up of. ?
Now ofcourse £16 or £12 is not £25 or £35 as before the 2006 oft review thing but can my claim be pursued in the same way?.
I'm happy to use court so is it worth my while and am I likely to suceed?
Guess I just want to clarify that i'm understanding what i'm arguing before I push on.0 -

Egg got a dispensation from the OFT for charging £16.00 but as I keep saying, the OFT also said that ONLY a court can decide what a fair charge is.0 -
hi got a final response from capital one do went to fos they have written back saying that:- there has been no charges applied to this account, pls note that we can only look at default fees that have been applied up to 6 years and from your notes the last charge was paid in 10/12/02.
So they have said that they have contacted bank for statements (but i have already got them) and that is all they can do. Has anyone got any ideas what i can do or is it the ed of the road.0 -

Hi I know its been a long time especially waiting for capital one, so do you think I should send them a letter saying that i would be prepared to go to court, I have the charges what they sent me so have got the evidence !!!!0 -
hi just spoke to cap one regarding a different account they sent me an offer which i accepted but they have told me this morning that they have sent it to caboot who they sold the account to and who we have goot an arrangement with to pay the debt off. we had no idea this was going to happen especially as we are paying caboot ourselves is this right? im not saying we dont owe the money.0

Hope you can help. I'm really losing patience with Barclaycard. I'm trying to get my CC charges recovered and have sent 2 letters (from here) to:
Barclaycard
Barclaycard House
PO BOX 5592
Northampton
NN4 1ZY
Following a chase up call to them as the 14 day deadline was up and I had received nothing, the Customer Service team said I was to send communiations to this address:
Barclaycard Plc
PO BOX 5402
Northampton
NN7 1ZR
So, I sent them a letter along with all the other letters and gave them another 5 days to get in contact. On the off chance I called them today simply asking if they'd received my letter and they said they hadn't.
Please can I ask you what is the best address to use for Barclaycard please. Reading older posts I see a link to the Cheif Exec's email which I also intend to use to complain but I'd like the best postal address to use as well to get my charges refunded.
