Thanks for your response. Knew about the 40 days but is that from when you send the letter or when they actually get it at their end? I think I worked out that 40 days from when I sent was yesterday?
Cheque came from my Halifax account.

just checked my Capital One account and they've put on a £12 charge!
Not very fair, it was due on the 7th so I paid it off online on the 7th! My statement says it was paid on the 8th! First charge, and surely the fact that I paid it online on the day it was due means there shouldn't be a charge?0 -

All credit cards say that payment should be RECEIVED on the payment date not necessarily PAID on the payment date. Challenge them and if you know the drill then do it0 -

Just tried calling monument now and got the run around. They say as this has gone to a DCA that they have no information on the account and can not provide statements. They are telling me I need to talk to the DCA.
On the plus side, I requested a copy of my CCA from the DCA and they wrote saying they'd get back to me as they needed to contact Monument, so doesn't look like they will be able to get that, which will mean its unenforcable
On the negetive side not getting my statements doesn't help me reclaim charges or proceed with my divorce0 -

Ask them to put that in writing to you that under the Data Protection Act 1998 that they have transferred ALL your data to a third party ie the DCA since that is a pile of crap.

Unenforceable is not unpayable. It means that it puts you in a strong position to negotiate with the original owner of it. Furthermore, if you stop paying then they will keep sending to Debt Collections Agencies forever.

Is this correct.

Thank you for the reply... Im at my wits end what to do, the terms are no win no fee and the cost is 10% of the claim.
Because of a fall in income and unable to make payments for a while our debt was passed to moorcroft debit recovery agency, since then we have been paying 10 a month religiously to them, but they keep hounding us for more.
The amount being recovered is much more than what we owe.
Have you any advise you could give?

I am in the process of reclaiming all of the charges I received from my HSBC Online Card but need a bit of advice.
I sent for the list of charges, which came back in no time. I then compiled the list with the interest via the calculator on this site and sent it with the first template letter requesting the refund.
That was over 14 days ago, and that is allowing for the bank holiday weekend, and still no response from HSBC.
I was wondering whether you would advise me on whether I should phone them, resend the first template letter or should I send the second letter threatening court action?
I have dealt with the same matter with my MINT account and that is now a complete transaction but I don't quite understand why HSBC are seeming more difficult to deal with?
Any advice would be greatly appreciated
