    Reclaim every single charge from both cards since the time the account was opened and see how much that comes to firstly. If they take him to court in February then you can at least claim that some of the amount owed is in fact charges that are covered under the Unfair Terms in Consumer Contract Regulations 1999.

    I think people are mis-lead by these claims on the CCA 1974 enforceability.
    If in the unlikely event it is UNenforceable the CC co. can & still will pursue you. The debt is not written off. It also does not go down well with the CC.Co.

    Law Firms and other are out there trying to snare people into signing up to pursue the claims on no win no fee basis.

    What is actually happening is that there appears to be a provision in the law for people to get legal aid (via Ins. policy) which are opened up by the solicitor if the applicant fulfils the criteria. This ensures their (solicitors)payment regardless and they will top up as many (250 pounds) hours as the can when it is probably obvious from the outset that the likelihood of success and its consequences are not good. This is a good little earner for little effort.

    If you think about a CC claim write to your card provider tell them what you have seen reported and ask if it does it apply to your account with them - they will explain to you and say if it applies if it dooes they may well settle with you amicably though not write off the debt.

    In my view CCA Enforceability is not designed or weighted to the benefit of the pursuant. The Solicitors will get their big bite of the cake everytime.

    This thread is NOT on ENFORCEABILITY but on CREDIT CARD CHARGES, ie the £12.00 ones and reclaiming them. If you want the ENFORCEABILITY thread, you chose the wrong one. Credit card charges £12.00 ones that were reduced in 2006 and the ones prior to that one are RECLAIMABLE without a CMC(in this regards we both agree).

  • citi card Why is it that I'm being penolised for paying my credit card of in full by this credit card company, I like to pay it of in full when I can ,So my bill came must be paid by 22nd March £!035.88 so I paid it in cash at the Bank on the 16th received my statement yesterday I owe £10.88 so I phoned them up was told it was interest I was fuming as you would expect so I phoned another number to cancel and pay of £10.88 only it had gone up-to £11.88 needless to say my card is chopped up in pieces and I told them I would sue them if I ever got another letter from them .so be aware about the hidden charges

    Did you take out cash on the card?

    I presume the credit card agreement allows you an interest free period in which to pay the bill in full (most do, but the odd one doesn't)

    Did you pay your previous bill in full also?

    It's the same with all credit cards; as soon as you don't pay one bill in full, you'll have to pay 2 in full in succession to stop interest accruing.

    Hi

    I am trying to pursue Monument for a refund of charges.

    I wrote to them on 10th Feb 2010 using the standard template from this website asking for my statements, to which I have received no reply.

    The account is in default and with a DCA so I do not have any recent correspondence from Monument.

    The addressed I sent the statement request to was as follows:

    Monument Credit Card Services
    Barclaycard
    The
    Portland Building
    25
    High Street
    Crawley
    RH10 1BG


    Does anyone have a telephone number I could try to chase them up, or is my address out of date?

    Hi all,

    Wondering if someone could help! I am trying to claim back charges from my Vanquis card. I sent them the template letter on the 26th Feb. In addition to the standard letter I also asked for my name to be changed as I have recently married, and enclosed my marriage certificate (along with the £10 cheque for my statements). I sent the letter recorded delivery.

    About a week later I recieved a letter back with my marriage certificate telling me my name had been changed. No mention of the claiming back charges part!

    I have checked my bank statements and my cheque was banked on the 9th March! But still no response. Not too sure what to do now?

    They have 40 days to respond to a SAR

    EDIT: Was the cheque banked onto your credit card or did the cheque go through your account?
